I wrote to them and they said they would look at it, they havent and have not started with the texts?

The only thing that will stop this at this point is to pay them. If you don't want to pay them you need to see what their next move is. What would you propose saying in a further letter?
Texts threatening court seem nearer to chav action than any kind of professional approach to instigating litigation. Perhaps there's a clue somewhere there for you

If this is possibly going to end up in court, I would go back to your original post and remove the exact times you posted.0 -
I was thinking of writing a letter back explaining that they havent acknowledged my previous communications other than saying we will look into it and charge you for doing so.
Thats my issue, they havent done anything. Ill dig out the last letter from them and the last paragraph that says about the fee to investigate and that they will contact me0 -
