Ok I know I'm late paying rent but is this a little over overzealous...

    Housing association. in England.

Rent is due on Mondays £100, I pay anytime up to Friday, I guess with the payment system it can take a couple of extra days before it hits my rent account, so yeah I'm late, this week I get a letter saying I'm 2 weeks late, even tho I paid a week on the Friday, I get a letter on Tuesday saying I'm late by 2 weeks (so 1 week was paid on Friday and the other week was 1 day late by Tuesday) even tho my online rent accounts says 1 week, no mention this is a problem for nearly a year until this week, when my tenancy is due to change from a starter year tenancy to a secured one, might have nothing to do with this but it does seem strange to get a letter again today saying I'm 2 weeks late and unless it's settled within 3 days an order of possession will be filed

I understand HAs need to keep on top of rent payments but to threaten a court order for 2 weeks rent seems excessive.

I agree with the majority on here: pay your rent on time - early even!

Court action for 2 weeks rent seems 'harsh' but when you are a habitual late payer, you deserve it frankly.

If you are on a 5 year contract - as many H.A's offer, then don't be surprised if they don't renew.

Do you know how much hassle and administration costs and time goes into chasing rent arrears?

Pay your rent, let go of the tired excuses, and be grateful you have social housing. There are millions of people who would give their right arm to be in your position.

update...just thought I would update this, I rang and spoke with the HA and they told me the letters are sent out automatically once the rent arrears go pasted a certain amount and they said my account was running fine till the time the letter was sent out, so they were not, as it's been suggested on here, sick of me paying my rent 1 week in arrears.
  • I've always paid rent by standing order on the date it is due and I've never had an issue.

I am a landlord and if the rent isn't in my bank on or before the correct days (unless they have advised 'bob rent will be 3days late this month is that ok?') then I am straight on the phone to them, if still nothing after 3 days or so I go round if they ignore my calls. If they aren't in I leave a note in the kitchen for them .

You let yourself into their home and leave a note in the kitchen?

it's their choosen 3rd party online payment system.

They can. I assume there is a choice of payment methods and this one takes 2-3 days. Even if there is no choice, if the deal is that the payment method takes 2-3 days, you need to make the payment 2-3 days before the due day, so you know that it hits your account on time.
Actually, sniggings has already clarified that the choice of payment system is made by the HA. And I disagree with your point that sniggings should be taking into account delays within the HA appointed payment method, because the tenant is hostage to any variable delays in the system of the appointed collector.

If the HA say that it must be paid to a particular collection agent, then clearly, they are agent for the HA in that respect and the HA should firstly factor in the delay to the rent demands and secondly they should take the risk of variable delays.

Mind you, I would agree that sniggings needs to get his act together.

Thanks, I normally pay the same week it's due, the HA say they have no problem with that, seems posters on here have more issue with it tho ;)

Funny I post about a different issue and get told I need to get my act together, yet the HA don't have an issue with the way I pay and it's them I'll listen to.

So you say. You have no idea what they're saying behind your back.

Good luck getting another tenancy at the end of this 5 year one. I am sure they will be more than happy to hand you another 5 years when your rent is CONSTANTLY late. I mean ALL landlords love nothing more than people paying their rent late, and they ALL have no issue with it at all.

Oh and look, there goes a pig flying past the window!

Maybe you shouldn't come onto a message forum asking for opinions and advice, if you're going to throw your toys out of you pram, and accuse posters on here of 'having issues' with the way you pay your rent, PURELY because people gave honest views.

    Seriously, some people!

I asked the question and was told the way I normally pay is fine, if you can't accept that and want to believe they are saying something else behind my back just so it makes you think you are right then carry on.

And who said it was a 5 year tenancy, I never, it's a permanent tenancy now. Sorry if I'm not sitting here worried for the next 5 years just to make you feel better about yourself.
  • Housing associations aren't able to evict people who pay the rent late once, the letter they issued you is part of the legal process they have to follow which basically puts you at stage 1. This may stay on your account for a while though so just ensure you make payments on time moving forward and you will have nothing to worry about.

Even when your tenancy moves to an Assured tenancy you can still be evicted if you get behind with serious rent arrears (more than a week)

YOU said it was not a permanent tenancy in your first post. You never mentioned it being a 'permanent' tenancy until now.

And if you think that 'having a permanent tenancy' is going to stop them evicting you for being a bad rent payer, you have a LOT to learn.

By your own admission they have already threatened you with court action if you don't catch up with your rent. So I am amazed at the lackadaisical way you are acting over such a serious issue.

You don't pay your rent and you WILL lose your home. So keep aiming your sarcastic put-downs at me by all means, but nothing changes the fact that you are in the wrong here, and you don't like people calling you out on it.

What amazes me though, is how you appear to have no problem whatsoever in paying your rent late. Do you think you're too important to pay it on time? Comments like 'so yeah I'm late' indicate that this may be the case.

I fully expect to see you on here in the future, asking for advice about the NOSP you have received. ;)
