But they are not married, and the OP doesn't say that he is the father of the 12-year-old boy. This doesn't exactly make them a "family" in this country.

Miss Moneypenny - the point is the EU National is NOT the claimant. As they have a child she is the partner on his JSA claim and therefore is not subject to the same rules as the claimant. Had she been the claimant then the information in your posts would apply but she is not claimant.
She certainly is a claimant. A joint claimant along with her partner thus rules apply.0 -

It's the incoming "partner" who has a dependent child, the OP has no legal connection to the two of them as they are not married.
Surely this doesn't mean that anyone from the EU with a child, and a friend in the UK, can come here and make a joint claim as a family?

Again, and louder, THERE IS NO 'PARTNER OF A CITIZEN OF THAT COUNTRY' QUALIFIED PERSON FOR FREE MOVEMENT and there never has been. It's only Worker, Jobseeker, Self Sufficient or Student qualified persons. Each of these have their own rules to be that status and what, if anything, they are allowed to have from that EEA country. And under EU law, an EEA county is allowed to change what they will give.
And a change of government in 2010 ended instant access to UK benefits and housing when EEA citizens arrive, even if they work.
A Brit must not take extra JSA for their EU citizen girlfriend who has moved to the country to be with them, nor must that EU citizen take that even as a joint claim with a Brit - because there is no 'partner of a citizen of that country' qualified person for EU free movement and a jobseeking EU citizen can no longer have JSA when they arrive.

All the UK is doing is bringing itself in line with other EEA countries, and then from April, reducing the benefits claimed for children to below that of France, Germany and Sweden.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

Even an EEA citizen can now no longer bring another EEA citizen girlfiend to the UK as their family member, unless they can prove they they have lived together, akin to marraige, for 2 years.. If not, that EEA girlfriend will have to be exercsing her own right to reside in the UK under free movement treaty rights, worker, jobseeker, self sufficient, student.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

Pardon my cynicism Miss Moneypenny, but how many EEA citizens have actually been deported without committing crimes?
The EEA 3 month limit is a legal fiction. In reality, no-one is going to deport anyone for merely not doing anything in the UK or elsewhere.From Poland...with love.
