    bazster , this company use PCS as there appeals service , this is ranked even lower than the IPC , the origionator (JD) will never see the appeal , and a reply will come from PCS / DR+ ,

    If he appeals to JD and the reply (whoever it's from) doesn't include a PoPLA code (or there is no reply) he complains to the BPA and DVLA.
    they are clearly working outside POFa

    I've seen nothing to suggest that, and in any case PoPLA is not conditional on PoFA compliance.

    Okay that's the next step for me then. I will get him to send me a clear photo of one and I will upload it on here and wait for you guys to pick it apart. I'm sure it'll have flaws from what's known about this guy.

    This is such a ball ache with the actual NTK being sent to the other end of the country.

    camera phone and email perhaps , who where you going to appeal to , what company , what address , and can I please re state PLEASE contact the DVLA whilst you are waiting , the info from them might just stop this in its tracks.


    Bazster , JD are not authorized by the BPA to use ANPR , therefore they must apply a ticket to the vehicle and wait 28 days before contacting the DVLA , they have failed to do this , so they ARE acting without the backing of POFa 2012 , and are breaking there agreement with the BPA and the DVLA

    Freddy, I keep saying that they are probably not using ANPR but a hand held. If it is a hand held, then the non-human aspects and conditions of numberplate recognition do not apply. Please, Freddy, read POFA 2012 sections 6 - 9 inclusive. Your interpretation is misleading OP into a river populated exclusively with fish of the red herring variety.

    Both the DVLA and BPA have sidestepped the issue of the 'man on a bike with a Samsung camera' using 'camera technology' to issue parking charges and NtKs within PoFA 2012 requirements.

    For someone who just wants to see off his PCNs, it's a blind alley. This is an issue for the activists to pursue. In my view the issue won't be resolved by the OP for the greater good.

    He should however, in parallel with (not as an alternative to) getting on with his appeals, determine how many separate requests were made for keeper details from the DVLA.

    so JD have gleened the info from the DVLA without just cause


    I know this will hit a brick wall with the DVLA , however the BPA WILL act and cancel .


    the OP needs to firstly check the number of requests , I can guarantee 3 in one day did not result in 3 separate requests , YES the BPA will be interested and YES they WILL act

    there are only two legal methods of issuing tickets
    1: anpr < 14 days to receive NTK
    2: ticket on car 29-56 day to receive NTK
    There is no requirement for a PPC to use ANPR. To satisfy the requirements of POFA for keeper liability the PPC must either:-
    1) If there was no ticket on the car they must send an NTK to the keeper within 14 days
    2) If there was a ticket on the car they must send an NTK to the keeper within 29-56 days

    Whether they get the vehicle registration number by ANPR or a bloke on a bike with a camera is irrelevant for the purposes of POFA & irrelevant to the DVLA. The PPC either has an EDI link for instant lookup of keeper details under a KADOE contract or they don't. If they have the EDI link they don't need to put a ticket on the windscreen as they will be able to deliver the NTK within 14 days. If they don't have an EDI link then they will probably not manage within time obtain the keeper details by applying using Form V8883. Although in theory if the DVLA were efficient & could turn round paper requests in a timely fashion then PPCs could still get an NTK delivered to the RK within 14 days of the 'crime' even without an EDI link & KADOE contract.

    yup , BUT unless they are accredited with the BPA for ANPR (they are not) then the DVLA are not allowed/sanctioned by law to release this info until day 28 for it to be POFa 2012 acceptable , and JD have broke there agreement with the DVLA ,


    therefore those tickets are not compliant with POFa 2012 , but there again , where PCS are concerned , this will not matter

    but they have not got a EDI link , thay have not been accredited by the BPA to use this method

    Please point to where all this is in POFA 2012 which is the place that gives the relevant service times and is the actual legislation.
