    check the numbers ...... call the hospital and ask them for the number ..... but above all keep trying ......

    they are the best bet for an easy cancellation

    Hi All

    Finally manged to get hold of someone in PALS - When i explained the case to them they said they do not get involved in PCN's and I would need to contact APCOA directly - He checked with his boss and he confirmed it that they don't get involved in PCN disputes.

    Feel like a just got brushed off :((

    you may need to go to the hospital and try and speak to some one who knows what they are talking about ..... may be you got the office junior :o ask for names ....

    Do not give in .... carry on with Pals .... they help elsewhere :)

    in the mean time have you started the appeals?

    tell them that Jeremy Hunt made all trusts liable and responsible for the actions of their contractors, including parking problems, in his august 2014 speech and new guidelines issued by his department last year

    if necessary, send a written complaint to the CEO of the hospital like fergie did in the thread I linked

    mention the Equality Act 2010 and you know your rights and expect them to know the rules laid down by the government

    also, speak to your local MP, send them an email, get them to start asking questions, they dont usually get the brush off

    Sorry Ralphy I must be missing something, which appeals are you referring to, thought I was supposed to wait for the the letter from the NTK.

    I am going to try them again tomorrow if I can't get through on the PALS side, I will try HR. I can't wait to tell them what Redx wrote, gosh i love it when you "know" what you are talking about.

    yes, wait for NTK in a few weeks time, then use the template appeal, plus free certificate of posting at the P.O.

    Hi all

    I called for the 30th time today managed to get through to an actual person :D

    He mentioned that they arent really responsible for the parking lot - I was expecting that - Then i gave it to him about: thanks redx!!!

    After he finished digesting what had been told to him, he said well that is true, and you can email the patient relations. He then went on to give me their email address, he said to attach photos of the scene with a brief description of what transpired.

    Just checking with you guys - I am not going to name the driver as mentioned above, but how should I sign off the email ? Also is it a problem giving them my address ?

    I'd fire off a complaint to the CEO about the fob-off. They know they are responsible so you shouldn't have to know a special incantation to get them to do their job.

    It probably costs the hospital some fee per cancellation imposed by them, so they are reluctant. But that's their problem and not yours.

    dont admit to being the driver

    just state that "the driver" parked in such a manner as to be able to exit the vehicle and use the mobility scooter in such a manner as not to cause any other vehicles to be damaged.

    also state that under the EA 2010 the trust has to make "reasonable adjustments" to allow this to happen and not to cause the driver to be treated in an unfair manner nor impede them in the execution of their reasons for being there (a valid hospital appointment) and that the BB was fully on display to indicate this persons rights under the EA2010 (keep mentioning it), so their contractor is in breach of the BPA CoP they are supposed to abide by too

    the petty rules that are being enforced discriminate against the driver being able to lead as "normal" a life as possible , plus the BPA CoP states categorically that a vehicle displaying a blue badge should not receive any such "ticket" as this vehicle did

    therefore you insist that the charge be dropped and the vehicle put on a "whitelist" to prevent any further occurrences, so that the driver never has to go thought this discrimination and unlawful impediment to their life in the future

    you can use a disposable email , make a gmail one up, or a hotmail one or similar

    use a serviceable address, one you can receive mail st, like a relative or close friend , use an initial like MR (or MRS) G SMITH , or just MR (or MRS) SMITH , or whatever

    dont sign anything either

    keep it as ambiguous as possible, keep saying "the driver" , not using the word I , as in I DID THIS, I PARKED THE CAR etc

    no me , myself or I

    to attach photos of the scene would imply doing it again, risking another parking invoice , do they really expect a disabled person to do that ? really ? telll them they should have CCTV footage and to check that if they really need visible proof ! ask them what a judge in your counter claim would make of such an outrageous request of a protected disabled person under the EA 2010

    so put that in your email too , also put a scan of the BB (cover the name) to show that this person qualifies under the EA2010 , and state the full version will be shown to a judge if this goes to the small claims court for a breach of the EA 2010 where they will be called to explain the actions of their contractor as per the 2014 guidelines issued by Jeremy Hunt

    mention that you may be informing your local mp and that you will be asking him to write to the secretary of state Jeremy Hunt for his views on this, plus to the Minister for the disabled too, Justin Tomlinson , plus the Communities Secretary Greg Clark , if this is not cancelled and measures implemented to stop this happeneing again in the future

    be polite, but be forceful, as you are already learning to do ;)

    write "the letter or email from hell" , in a polite but forceful way, ramming home all the points above

    well done , and good luck

    be like that fergie I linked you to, who was up in arms about the shabby treatment his wife received as a BB holder and disabled person at his trust , which was another failure of the EA 2010 on their part (plus no contract)
