Hi
I need some advise regarding the above - There was a disabled person who received this ticket when they went to hospital. The contravention was based on the fact the "one of the tyres" was very marginally over the white bay parking area . They had to park this way in order to create space for the mobility scooter they use, to get through easily.
Can someone give me advise as to how to proceed in rescinding the PCN.

[5]I did try reading through it but didn't understand anything all this is quite new to me, I understand you probably get hundreds of people like me every day, but as i said it is for a disabled person who cant really fend for themselves and I am trying to help them out, so would appreciate all the help you guys can give.
You can imagine going to hospital which is an ordeal in of itself, waiting for who knows how many hours to get seen to, and then getting slapped for a marginally over tyre, I mean come on!!! What is the world coming to ???

1. You need to wait for the Notice to Keeper from APCOA which should arrive between day 28 and day 56 after the parking incident. You then need to send them the initial appeal detailed in post #1 of the NEWBIES FAQ sticky. Make absolutely no contact with them before receipt of the NtK.
2. This waiting period gives you time to complain to PALS. They should be 'on your side' and can get this cancelled. From the NHS Choices website (via Google).https://www.nhs.uk/chq/pages/1082.aspx?CategoryID=68

in simple terms then
1) wait for the NTK as mentioned above (day 29 to day 56)
2) PALS is the liaison service at the hospital, they should take your complaint on board and deal with it, so speak to PALS or the human resources dept at the hospital, insisting they cancel the charge under the Equality Act 2010 as you are a blue badge holder
complain to the BPA by email that apcoa have ticketed your vehicle, despite it showing a BB and the BPA CoP says it should not happen
you are protected under the EA2010 and a landowner (the trust) have to make reasonable adjustments for your condition, you made your own reasonable adjustments, their contractor hasnt, so you have a case against the trust, which is what you also tell the trust , or PALS
if you didnt know what pals was, all you had to do was google it, but I have done it for you, so click here

now apply that info to this hospital
come back and tell us what happens with all the above, dont leave it, dont make it worse, insist on a cancellation
do not name the driver, refuse to name the driver (assume I was driving - you dont know me)0 -
when reading the newbies thread , do not try to read it all at once......
try picking out small bite size chunks ......... don't read to far down until you have a reasonable understanding of the bits you have read......
for example .... do not try to read up on court cases while you are still at the first appeal stage ........

From what I've understood, please correct me if I got this wrong, I should in no way contact Apcoa or try to fight them for ticketing me.
Rather my first point of call is PALS - I should call them today and try and get them to revoke the ticket based on the EA2010 ? If they say they cannot revoke the PCN and that i need to speak to Apcoa directly what do I respond to them ??
Just for clarification is there a problem telling PALS who the driver was if they ask, or should I just ignore the point with them??
If I wait for the NTK (not exactly sure why I'm doing that) but will that not increase the charge on the PCN ??

you tell them that you are an occupant of the vehicle, thats all they need to know, I could have been driving you there and parked accordingly (I have a BB too , so know the score , so assume that I took you there and parked using your BB - not mine)
you tell PALS you were present on the day with the BB, dont reveal the driver and insist on your rights under the EA2010 and that the BB was displayed correctly so they should get the apcoa charge cancelled immediately
you only deal with apcoa AFTER they send you an NTK, in 29 to 56 days , again not revealing the driver, using the template letter from the NEWBIES sticky thread
so you dont tell anybody who the driver was, or is , not even us !
follow our advice and you will pay nothing, providing you do things in the right order at the right time0 -

Don't go all technical on them, they're supposed to be on your side! Read the Newbies thread as to the process and why the advice is what it is.
Since you will not be paying a penny it doesn't really matter what arbitrary number they increase the charge to.Je suis Charlie.0 -

I have tried numerous times to get hold of someone in PALS and every phone number seems to go through to voicemail. It doesn't seem like there is anyone there at all.
Has anyone had a similar experience / advise or what I should do?
