OP, as you say that the limo company's boss is shouting at you when you phone, I would suggest that you put you complaint in writing.

Keep it very factual, not over e motional, and be clear about what you want.

    Be specific about what happend:

    e.g.

"On [date] we booked a limo, to collect [number of kids] from [address] at [time]. It was made clear at the time of the booking that this was time-sensitive.

On [date of prom] the full party was waiting at [address] at [time]. The Limo did not arrive.

At [time], x minutes after the limo was due to arrive, I / other parent telephoned your offices but no one answered the phone.

At [time], x minutes after the limo was due to arrive, we received a phone call from [name if you have it] who stated that he was the driver of the limo and that he did not think he would make it on time. (if he said how long he thought it would be, then put that in]

At [time] the limo has still not arrived, and as any further delay would result in the children missing the tart of the prom, we had no alternative but to take take them to Prom ourselves. "

then go on to say that as the company failed to provide the service agreed upon you are seeking a full refund of £500, and that in the event that you do not receive the refund in full within (say) 14 days, you will take further action.

Once again, what does the company's cancellation policy state...?

All that said, I think the issue is whether, legally, 20 minutes delay would be considered sufficient to frustrate the contract.
I personally can only judge by the limos etc. which go down past our office at this time of year, from which I'd guess that arrival times range over a longer period than that, and also on whether and to what extent it was made clear at the time of the booking that time was so critical.

Did ou hone them again before settingoff in your own cars?

To get back to my original post, an update:
I am having no joy with the owner of the limo firm. He refuses to meet us to discuss the problem. I have now contacted VISA to see if they can help (the payments were made through them). I will see what they say and then get onto the local authority private hire licensing people, and trading standards.

    I hate cowboys.

Easy. "Children, £500 is silly money. I'm not paying."

As others have said, I don't fancy your chances of getting your money back. If you paid by credit card it might help.

I didn't pay it. My son and his friends split it between them, and they paid it out of my son's bank account.

Umm, your son needs to be doing this. You have no standing at all in this matter.

He has a contract with the firm, not you, and his bank will not - or, rather, should not - deal with you regarding a transaction on his debit card.

Company's cancellation policy (from their website only, as we've had nothing in writing from them) is not time specific. It says "all monies are none (sic) refundable if you cancel for any reason."

Even them not turning up 20 minutes after they're supposed to? I think not.

I've been to the bank with him, we've written the letter together, from his perspective, and he's signed it.

    Thanks Adrian.
