well the builder has his own share of responsibility too. I mean we even have a visitor park, he just didn't pay attention and I forgot to tell him.

I am completely gobsmacked by this thread.

Your posts show how naive you are about the parking skimdustry yet you and your colleagues on the residents committee engaged a PPC !!??

As their client (and someone who is presumably aware of the contents of their contract) you were in an ideal position to get this cancelled but you have just let your builder pay it

Why didn't you as their employer just demand they cancel the charge?

Or have you and your colleagues also been naive enough to agree to a no cancellations clause in the contract you have so foolhardily entered into.

You and your colleagues need to wise up and fast before you face claims against you for the actions of your agents for which you are jointly and severally liable btw!!!!!

yes that's it, I didn't realise many things about how it actually works, assuming of course what you are all saying is right.

Where I come from, for example, it works exactly in this way, first you pay then you complain and get a refund in case.

I understood from what you said that those company are not entitled to enforce payments, but this is all new and grey area to me.

I wonder if someone on the resident's committee is getting a backhander from the parking company?

unluckily the GM happens once a year, so I have to wait for the next one to investigate.

And yet you participated in engaging a PPC - unbelievable!!!!!!

I appreciate things may be different where you come from but if you are going to take on responsibilities here you need to be aware of what you are getting yourself and others into - ignorance is no defence in UK law

ignorance is no defence in law in any part of the world I believe. However I don't understand why you mentioned it, are you telling me that I somehow broke the law?

I fail to see where this "where I come from" fits into this

doesnt matter where you come from or what they do there, you conform to the laws or rules of the place you are in , not somewhere else

if a 17 year old person from the uk goes abroad to a country where the age for a driving license is higher, he doesnt drive , neither does a 19 year old buy and drink alchohol in a country where its for example 21 or older as an age limit

different places, different laws, but ignorancxe of the laws (or sc@ms) is no excuse in perpetrating them

    just a thought

personally, I hope that your "comittee" falls foul of this with a determined disabled person prepared to bring a lawsuit against this residents committee plus the PPC, teach them both a lesson to do (as they say on homes under the hammer , "READ THE LEGAL PACK" , or have it read by a lawyer

well sorry if I say that, but I fear you have been a little bit to extreme in your judging.

Failing to understand that you consider all the PCN scam doesn't mean being ignorant of the law. If these company were all scams, probably they would not exist, right?

I found extreme to compare breaking the law to not being able to see that the driver shouldn't have paid at all despite warnings of further prosecution.

I will consider your suggestions for the next time it happens to me personally, but I cannot consider what you say law.
