Not sure if you would really be 'reasonably' entitled to this - especially since your point all along has been 'this is taking too long', and now you'll potentially cause a delay yourself by taking the newer model.
If you can get ANY brand new one (or anything with lower mileage and at least as good spec as yours) you should bite their arms off!

The dealer said the fix to my car would potentially take longer than waiting for a new one off the production line so no way am I causing the delay!

I have made it very clear its brand new or a refund I am not accepting a second hand car. I apologies if that sounds harsh and unreasonable but we have been through a lot of hassle which Land Rover and the dealer has acknowledged and accept and in their words they want to do the right thing for us and put this right. I am hoping if a brand new car wasn't an option the dealership wouldn't have offered this in the first place when I asked for my money back.

I hope you are right OP and they aren't just upselling you.

I hope I am right too, I am not paying a penny more and I have told them that!

Well done you. Does the new model come with LR's new ingenium engine?

I believe it does but I will check IF they offer me a new car

Would you accept a brand new current model?
  • It is reasonably common for JLR to offer replacement cars for troublesome ones based on a sample of my Land Rover owning friends.

You stated you wanted the "new" model out in September. As already asked if they had a "new" one available today would you take it?

Also, it's all well and good throwing round the SOGA etc but please bear in mind you have had over 12 months use out of your car so you wouldn't really be legally entitled to a full refund or a new vehicle. The dealership seem to be acting quite reasonable imho.
  • When I was discussing the options with the manager I never thought about the new model to be honest it was him who indicated that it would the new model he would look to offer me. Who wouldn't accept the new model if its on offer?? Ok I may need to wait another 7 weeks but I am going to have to wait even longer for my old car to be fixed. I totally agree the dealerships are being very reasonable and the manager was very genuine and nice.

Neilmlc - IMO I think I have every right to throw around any law/rule when I have paid 10's of 000 of £'s , which I saved really hard for, for something that is faulty after 12 months of careful use and up to now waiting patiently for my car to be fixed to no avail. I suspect many more people would have lost patients long ago and have even higher demands then me. I would be interested to learn what you would do differently and what you would accept as a satisfactory solution if you were in my position?

What I would do is fully understand the legal position first. You stated that under the SOGA you have a good case for a full refund, well in reality, strictly speaking you don't, it is simply the dealership that are prepared to go beyond their legal obligations.

You ask me what would be satisfactory, a car of the same spec, age, condition and mileage would be sufficient and maybe something to compensate for your trouble.

You have a 12mo/12k mile car now, right? Whilst your own car has been out of action, you have had use of an equivalent replacement, right?

I don't see why a straight exchange for a different 12mo/12k mile vehicle would be unreasonable, tbh. An exchange for a new vehicle is a substantial goodwill gesture on top. Compare the retail prices of an approved-used 12mo/12k mile vehicle and a similar new one to get an indication of how substantial that goodwill gesture is.

Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..
