You are talking about a MVNO going bust - apples and oranges.
They are shutting up shop so refunding FOC isn't unreasonable.

At least they are letting you use it up - much better than summarily being blocked and losing your number with no number port. If you want your credit, you can request it but there's a £5 charge. All mentioned within their T&C's.

Where does it say that you can have your credit for a charge of £5?

It's always had that in the terms and in the list of charges.

Can you point me to that particular term on their website?

It clearly says in the FAQ you cant get a refund.

"How do I close my Family Mobile account?"

If you want to close your Family Mobile account, simply follow these steps:

    1. Remove your SIM card from the handset
    2. Log onto 'My Account'by typing in your usernameand password in the log-in box
    3. Pay any negative balance you may have
    4. Call our customer services and ask for the services to be closed
With possible delays in updating your account balance, especially if you have used your phone abroad, it may take up to 30 days to fully close your account.

Please note: There is a £5 administrative fee for closing your Family Mobile account. Any remaining credit cannot be refunded.
Please note: If your account balance is negative, you should pay the amount immediately or risk being invoiced further.

    The T&C say

8.1 You may ask us to cancel the Agreement at any time from your Account on our Website. To do this you need to be logged onto your own account with your password. We cannot refund any money as the SIM card was free and credit will not be returned.

8.4 We reserve the right to cancel this Agreement without refund at any time, and for any reason, upon giving you 30 days' prior written notice.

Not all T&Cs are legal, fair and enforceable.

Having said that, the chances of punters getting any money back is slim. I guess most, perhaps all, will fortunately only have a small credit balance.

In 47 hours time, according to new Ofcom rules, they should be offering free calls to 080 numbers and applying the 'unbundled tariff' structure to calls to 084, 087, 09 and 118 numbers. Failure to do so will be a breach of Ofcom's 'General Condition 17'.

Asda refused to refund outstanding credit when it switched from Virgin to EE

Changed it's mind once the newspapers, radio, and on line bad publicity followed

Not a customer of Ikea, but was customer of Asda and had a voucher credit to spend in shop

"just" - Do you mean that Coms have sold them to another company, ie yours, or do you man that you work for Coms?
