Taken to Court for “unauthorized occupation”… but I don’t even live there ?! Help !

    they don't even have a website, nor they are on Tripadvisor.
    You don't need the above to be a business, which unless by 'hostel' you mean an individual letting strangers sleep on a matress?

    Any business owner can write a letter that says ' I, owner of business X of Y address, registration number xxxx, can confirm that Mr Z has been staying regularly since xxxx and can confirm that he has made payment of x for the following weeks in the last 6 months.

    You then go to your bank and ask for bank statement that shows that amount of cash taken out the same week.

    Frankly, considering you seem much more interested in finding out how to avoid going to court than how you can prove your residency, in addition to all the parts of your story that don't stack up, it is getting hard to believe in your story. If you are honest, I don't think anyone can give you more advice than what you've been told so far.

    you've been paying to live in a hostel for many years apparently? your friend goes away and asks you to keep an eye on the property while she is away? ..... light bulb moment!!!! ...... if i stay round linda's i don't have to pay for my hostel!!..... can't get receipts from the hostel because you've not been staying there since lindas been away, panicked when you realised the council were on to you so started to stay at the hostel again hence only having recent receipts......

    i could be totally wrong but thats how it sounds to me.....

    Either the OP can provide proof of residency elsewhere in this case proof from the hostel or they can't. The fact they have been having post sent to the property and arranging for repairs. Repairs that wouldn't have been obvious unless the property was occupied.

    Time for the OP to either proof they weren't resident or own up to what has really happened.

    Very dodgy story indeed. You need to clarify what they are taking you to court for. Can you post up the contents of the letter?
    Is the letter addressed to you personally? Has Linda received the same letter too?

    There is no way you can possibly owe the council any money. Either the rent has been paid and the council can't claim it twice, or the rent hasn't been paid and it's Linda who owes it.

    My best guess is that the step father hasn't been paying the rent and the court hearing is part of the eviction process so the council can get the flat back.

    Unless the OP can give some more specific details then everybody's time is being wasted repeating the same thing over and over again.

    A CCJ won't affect you as you don't live there. You won't have a credit history as you won't be putting that address on any applications.

    Credit history is linked to individuals not properties, so a CCJ will affect the OP, especially as judgement will be granted by default if they do not turn up or submit a defense.
