    Following on from my email to Popla, I have received a reply from their admin team which states that they have provided the operator with an additional 7 weeks, from the Popla appeal date, to provide their evidence package to me.
    It appears that popla are bending over backwards to help the operator.
  • Advice please.
    Having told popla that I have not received any evidence from the CPC, popla have given them more time to send me the package and issued them with a cut off date for when I should receive it, and popla have asked me to confirm if I have received the evidence.
    That date has passed and I still have not received any evidence from the CPC. In addition, the 'submit further evidence' with popla no longer appears to be working as it cannot recognise my popla code even though my appeal was sent in July. Therefore, I am not able to add the fact that I do not have the package as further evidence.
    Trying to communicate with the popla admin team, in my experience, has been a complete waste of time and, so far is getting me nowhere.

    Have you phoned POPLA to tell them this?

    You need to make contact with them asap. I'd send an email pronto. You might also try to telephone them.

    Have you checked your email junk file, as there have been occasions where PPCs evidence packs have been shunted into 'junk' (perceptive email software perhaps? :))

    Thanks umkomass and castle for the advice.
    I have emailed popla again - this will be the 4th time ( over the last 7 weeks ) that I have advised popla that I have not received the evidence package. Just wondering how many more chances they are going to give the PPC !
    I have asked popla to allow my appeal but they appear to be giving the PPC every opportunity to succeed.
    Appears that the PPC are quick to send out NTK and appeal rejection letters by post but try to screw the appeals procedure and the appellant by using other ways to correspond.

    I have eventually received the PPC's evidence package by post which is 8 weeks after the popla appeal date. Should I go through the process of challenging the evidence even though it was outside the 'last' cut-off date issued to the PPC from popla ?
    If challenge is still necessary, would it be sufficient just to highlight that there is no contract between the PPC and landowner (contract copy not supplied by PPC in the evidence package even though they stated in the main text that it was) or, rebuff all the boll***s that the PPC has dreamt up ?

    Your help/advice would be most welcome.

    You need to urgently contact POPLA to tell them that you've only received this today - and emphasise the lateness. Ask POPLA to stay your case for x number of days (normally they give you 7 days), so try to agree a timescale with them.

    You need to rebut every point the PPC makes with which you disagree, or that is just plain wrong. You highlight any vital evidence that has been withheld (or not included) by them - the contract with the landowner is an absolute essential to be included in your rebuttal (especially if this was covered by you as one of your appeal points in your POPLA appeal) - so make great play on this.

  • Thanks ummkomass. Have started to make notes relating to the tosh (I mean evidence) that I was sent.
    However, I have just read that the popla team have disbanded, and those appeals held back as a result of the Beavis decision (as in my case, according to the popla admin), will not be acted upon by the new ombudsman team so will be in limbo.
    So, should I be concerned with timescales ?
