Section 2(c)(iv) of the Terms and Conditions for American Express Card Acceptance prohibits a surcharge for accepting Amex that is not "imposed equally on all other credit and charge cards". Furthermore, Amex is not going to facilitate the software enhancements necessary to display the type of message that you suggest. A merchant can surcharge for credit cards over debit cards, but only by the difference in the cost borne by the merchant, as stipulated by the Consumer Rights (Payment Surcharges) Regulations 2012.

I didn't know that but that makes it simple then....AMEX won't be offered by places who won't be paying the higher AMEX charges.

Well that's not correct. With RBS and NatWest you get 1% cashback for any contactless transactions made with your debit card. .

Well that's only partly correct. As they won't pay you any cashback if your contactless payment is over £20.
If you have already registered for Cashback Plus for your cards, you will continue to earn the rewards on payments you make up to £20 using Apple Pay. If your Apple Pay transaction is for more than £20 you will not receive a Cashback Plus reward on that transaction.

Saw someone mention McDonalds and I had difficulty there the other day with Apple pay on both of my registered credit cards. Both 'failed' via Apple Pay, but gave no error message, just nothing at all. The physical card then worked so there were no issues with the card, and I successfully used Apple Pay several minutes before and after at other retailers.

Anyone else had issues with McDonalds? It's ironic that they are the only retailer I have not been able to use Apple Pay with so far, but are also the only retailer I have seen so far who have gone to the trouble of sticking up 'Apple Pay' stickers all around their tills.

I've got an Amex card linked to Apple Pay and it has not worked once. Tried it at McDonalds, Tesco and Asda - each time, the phone shows a 'Done' confirmation but the merchant payment terminals just sit there waiting for payment.

I have to take out my actual card to make the payment (and I am keeping an eye on my transactions in case there are any duplicate payments taken).

    Same here!
No succeed amex apple pay, tried TESCO, PRET, COSTA, M&S, MCDONALD'S, all failed.
But visa with apple pay works fine, and amex physical card contactless payment works fine, talked to Amex regarding the issue, but no response.

Have either of you tried Apple Pay with Amex on Transport for London? If it fails there, then it could have more serious consequences, such as liability to a penalty fare. This would give Amex a greater incentive to resolve it for you.

Yes, it was I who reported that it works, as have thousands of other people. My question is whether it works with your Apple Pay and Amex, given the problems that you have had with it elsewhere.

Not tried it on TFL, but I don't take the train/bus so it may be a while before I need to.

At least I'm not alone, I couldn't find anyone else with the same issue until now...
