Thank you! I actually phoned the HMRC. They said I could claim it back. They also said something that's not on the website. They informed that as long as you lived as 1 unit, so living together, you were eligible for marriage allowance. You didn't necessarily have to be married to get it.

When will they stop making it up as they go along?

HMRC staff are getting worse and worse.

To qualify for Marriage Allowance you have to be in a Marriage or a Civil Partnership - both of which are defined procedures involving actions, documentation - and payments.

Living as one unit has no meaning in this context.
  • I am married but separated and living apart.
We have no intention of getting a divorce.
Can we claim the marriage tax relief?

Yes - but not "we", just the donor :)

Does one of you have income below the personal allowance and the other not liable to higher rate tax?
  • Sorry if this is already been covered I have registered for the marriage tax allowance and received a letter back saying my tax code will be changing all good there, But I didn't received any tax rebate letter at cheque along with it.
Does it get posted out separately or do I need to apply for it ?.

Cheques and notifications usually come separately.

What year is the transfer for.

If 2016/17 then any rebate will be paid through your wages when your employer uses the new code number.

If you claimed for 2015/16 any rebate will be paid by HMRC in due course.
  • I presume my situation means I cannot claim the marriage allowance by the fact that my wife has no National Insurance number.
She has lived in the UK for 7 years, is now retired, has no income and is a dual German/US citizen who pays no tax.
I am a basic rate tax payer.
Putting the question to HMRC no one could give an answer to the question or where to go for an answer.
  • I've discovered that thousands of people, maybe tens of thousands, are being given wrong information by HMRC. I received a P800 from them which is supposed to show clearly how your tax code is calculated. However it only shows the standard personal allowance despite the fact that I have elected to transfer the married allowance from my wife (her code was correctly reduced of course). I called the customer service and was told this is normal but the tax calculation is in fact correct. I asked for a corrected P800 but when it came it was exactly the same. They are deliberately sending out incorrect documents. Having made a written complaint, the reply is that this issue has been passed to the "learning lessons team" but I won't necessarily hear any more from them! What a shambles, wasting taxpayers money on sending out explanatory documents that are knowingly confusing. I've now written to my MP so we'll see what response I get.

Why not apply for a NI number for your wife? Call 0345 600 0643, Mon-Fri, 8-6.
