You need to state in your defence that the purported assignment is of a bare cause of action and was made for the sole purpose of enabling MIL Collections Ltd. to bring a suit against you. The purported assignment is therefore champertous and void. Accordingly MIL has no claim against you and no cause of action.

Have a search on PePiPoo as there were a couple of recent cases where this further 'reassignment' from CPMS - CPMS Ltd - MIL was discussed.

I've had a quick scan through, but time's tight for me, can't immediately locate them, but I think page 3 of the thread list might be somewhere around the mark.

Hi Umkomaas,

I've had a good flick through them a few times, Gan offers some sound advice, only thing is there is nothing I can find on how to reply as a "response" letter following the PD rules.

I think even though there are various MIL Collections going about, none seem to be at where I am. They are either at the court stage but haven't written any letters previous, or have received letters similar to mine but haven't replied yet.

Having seen the rather less redacted version then that above of the further response from MIL it is clear that they themselves drew up the assignment letter.

In fails fundamentally to meet the requirements of an assignment but then we shouldn't be in the business of doing MIL's work for them so I have no intention of expanding on that. If they do not understand the law then that is most certainly their problem.

Personally, I would suggest that the OP desists from publicly posting the letter chain at this stage as he is simply providing MIL the opportunity of knowing what's coming their way.

They were done away with as crimes. Champertous assignments will still be struck down by the civil courts.
