enfield freddy CPMS or CPMS ltd?

check the date of the offence

It will be CPMS Ltd, however, all signage and paperwork (debt collect letters) is all CPMS. I think the only letter that is CPMS Ltd is the most recent letter from MIL because of everyone questioning this.
Umkomaas Keep on researching and building up your knowledge base. No one has every answer under the sun available to beat everything thrown at you, but, between us we deliver a pretty reasonable 'opposition'.

Thinking about it, between us, we rarely lose!

In all honesty, even though the situation is not something anyone wants to be in, it's been a good learning curve. Anyone who receives a PCN I direct them to this site whereas before I had received the PCN I just thought paying the lesser fine would of been acceptable.

However some people still think the ignore everything is the right thing to do

Which might well bite them on the derrière if Beavis goes the wrong way. Hopefully their local pub [STRIKE]idiots[/STRIKE] advisors will underwrite their advice!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

yup CPMS , thought I remembered them

    copied from pepipoo: (Sgt Dixie)

MiL appear to have purchased a number of so-called debts from CPMS Ltd of Manchester.

If that is the case here - and the company referred to is Car Park Management Service (CPMS) Ltd with a registered office in Bristol (although they operate from Wigan) - then there are a number of potential problems from MiL's point of view:

    1. CPMS Ltd were not incorporated until June 2014 - over 6 months after the alleged debt was incurred
    2. At the time CPMS was operating as a sole trader - a separate legal entity
    3. Reliance is being placed on POFA
    4. The one example of MiL's LBA so far seen did not comply with current PD's

what date did you get the original ticket?

The original ticket has CPMS Ltd on it. It doesn't have the Bristol address it has the Manchester address. The original CPMS paperwork has Ltd on it aswell. However, all their signage at the site is either broken and none existent and does not have Ltd on it so when I searched the company up (CPMS) it didn't exist. So the supposed contract for trespass was with CPMS who didn't exist and were acting as a sole trader.

The debt collect letters all had CPMS on not ltd as did the original letter from MIL.

The LBA states "CPMS (the seller) to MIL Collections Ltd (the buyer)", CPMS does not exist.

After questioning this that's when the agreement of assignment arrived between CPMS and CPMS Ltd with a letter from MIL now saying "outstanding debt to CPMS Ltd".

Long story short I think they have realised they have dropped a b*****k.

Original ticket was after the incorporation of CPMS Ltd.

I'm about to write up as response to request information based on is it the what the claimant wants etc? The grounds etc and how much is it?

    Cheers Umkomaas and Freddy

I'm also looking to add this into my letter.

The first two LBA letters received, one is CPMS supposedly assigning their debt to MIL Collections, received with the other letter stating MIL Collections buying the debt from CPMS.

The second two letters received, CPMS assigning all liabilities to CPMS Ltd, MIL Collections acknowledging this.

Who has MIL bought the supposed debt off? It's all a contradiction in writing. They say they've bought it off CPMS, who do not exist, then send another letter to try and explain CPMS assigning liabilities to CPMS Ltd, so they are now dealing with this company.

I'm no expert but surely if this ever went to court a judge would just throw this out?

If I post a draft letter up when it's ready would you be willing to help as I'm not too sure how to present this information in a formal way.

Not to worry. I'll post it up anyway and any feedback/advice is always welcome.

I'll have a look now at it see if anything is useful.

I've got an idea of what is required and written a draft which I think everyone will kind of see what I'm aiming for. Just needs experience to alter it as they see.

I've also invested in "The Parking Prankster" just incase it does go to court for more advice
