PPI Reclaiming successes and failures

I recently put in a complaint for ppi on a credit card that was taken out in 1996.
I have had a reply from LTSB to say that they are unable to give me a final response in relation to the complaint due to, 'needing to wait for the FCA rules and guidance that are coming out next year', in order to 'assess the certain category of complaint relating to the level of commission on the PPI not being disclosed'.Has any one else had this response, and does any one know what it means for my complaint?0 -
It basically means your complaint has failed, but the Plevin Ruling means that you may still get a refund of any excessive commission which may have been paid.
You'll have to wait for the FCA to produce the new guidelines before progressing any further with an Ombudsman referral .0 -

I have re read the letter and see that this is only covering the period from October 2000 to present. I rarely used my card during this period, hence the 12p. My claim referred to the period prior to this as I applied for and used their chargecard extensively during the 80's and 90's. Do I go back to M&S or write to Ombudsman? Advice appreciated.

Do you have proof of the payments in the form of statements? Did you supply them with copies?
If they don't have records they can't do much unfortunately, the fact they can go back to 2000 would suggest they have deleted the old files or can't find them or maybe they didn't add the PPI until October 2000.
FOS can't magic up documents either, referring it to them is not going to get you any more money unless you have proof you paid it.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Thank you for your response.
I am confused as I explained in the complaint that I was unaware of the PPI, not remembering the time of being sold and also over the years not being aware it was part of the payments.
I explained this to LLoyds as I had to give extra information over the phone, also explaining that having been off sick and struggled with payments at this time - had I known I had PPI I would have claimed. Other people have explained successful complaints with almost the same story. Do I wait for the FCA to bring out their ruling and then proceed to the Ombudsman if it remains unsuccessful?0 -

Do note that the success (or failure) of others has no bearing on your own result.
Also note that not knowing you had the PPI would usually indicate that you have forgotten about it, not that it is was (mis)sold to you without your knowledge or permission.0 -
Hi im completely new to the site and hoping for some advice please. I made a claim with Barclays for PPI on an overdraft Id had since the late 1990s. I was told on the phone yesterday that my claim has been upheld and I am to receive a cheque for just over £5,000.
I am of course delighted however, I do have a question. I am currently in a DMP with Stepchange and I am also repaying said overdraft back to Barclays monthly.
Can anyone tell me how this refund from Barclays will affect things. Im presuming will take their money for their overdraft out of the refund before sending me the balance or will they send the balance to Stepchange?
Any advice or directions to the right forum (if not this one) would be much appreciated.
Thanks so much0 -
I wonder, due to the number of posts / people on this thread, whether anyone can advise me. I KNOW I had an Egg card many years ago (15-16 years!) however, it was paid off and any information is long gone. Is there any way I can enquire about PPI on it?
Many thanks!"Buy me, Lady", said the frock, "and I will make you into a BEAUTIFUL & WHOLE & COMPLETE human being"."Do not be silly", said the Man, "for a frock alone cannot do that"."True", said the Lady, "I will have the shoes and the bag as well".:rotfl:0 -

You'll need to speak to Barclays, no point asking on here as cases are individual - they are within their rights to offset any refund against any unpaid debts (money written off, interest not paid etc) and then should pay the rest out. As it's a DMP not say an IVA or bankruptcy you may end up with the cashSam Vimes' Boots Theory of Socioeconomic Unfairness:
