PPI Reclaiming successes and failures

Further update , wrote back to RBS asking them to reconsider their findings . They have responded , they have no intention of reviewing anything , if not happy contact the FOS .
I will send off a copy of the questionaire I originally sent to RBS ,along with other paperwork (the application form).
Should I also include a cover letter outlining my complaint and if so , what form should this take?

Sorry to hear this.
Yes send them a copy of the questionnaire and any copies of evidence you may have to support your case/copy of your agreement etc.
The Complaints form you will find on the FOS website, you can download and print, or ring them to ask to send one through the post, also remember to keep completed copies for yourself.
And if you want to write a letter, for instance if there is no space left on the FOS complaints form then that is fine.

In my opinion the FLA are a waste of time.
Even though the FOS will be unable to investigate your complaint because they were not governed/regulated when you taken your your loan, you can still contact the FOS for advice.
The FOS have suggested for cases like this to pursue the actual underwriter/insurer as another avenue, as these would have been governed and had part liability - such as when your loan was approved.
Sometimes you have to request from the (lender) for the PPI policy details, as these are not always enclosed within your loan documentation you would have received after the loan went through.
So give the FOS a ring anyway, I do think they will ask you to go for this direction, like many of us have.

What are the odds like with claiming against the policy writer as this is now the second one (see earlier posts ref marks and spencers) that I have had to go down this route now and the first one has denied any involvement and told me to go back to Marks and Spencers.0 -
Hi I remember your post on this and wondered how far you have got with them. I am waiting on a further response following them saying they were looking into it again. I too sent a letter to Allianz and havent even had an acknowledgemenet which I feel is pretty poot. I wiwll be writing back this week to ask what is happening, meanwhile, M&S said they would come back within 4 weeks(ish) but I dont hold out any joy. Still must keep at it!

To be honest mine is still with the FOS, but recently been passed on to the adjudicator, so this is ongoing.
The FOS did state that Hamilton (the insurers/underwriters) have not accepted any liability, but the adjudicator are still willing to investigate and do not want to let it go.
There are a lot now to what I know of gone this direction as suggested by the FOS, as the FOS are trying to make these responsible as well, as they would have been involved to have approved the loan also the ppi.
I am checking for posts - updates on others who have gone the same direction, but at least so far the FOS want to keep on with the investigations.;)The one and only "Dizzy Di"0 -

Allianz have replied saying that they are not responsible so I sent the second letter template on the 26/07/2010 giving them 14 days to reply. I have not received that reply so I have sent them another letter today requesting they repay the full amount and the stautory interest.
If I do not get a reply by August the 30th I will send everything I have on both M and S and Allianz to the FOS.
By the way the address I got a reply from was Allianz Insurance, PO box 589, Great West House (GW2) Great West Road, Brentford. TW81AH.

Dear All,
Feeling a little bit celebratory with this one, as it's my first brush with standing up for myself and not being in fear of the financial institutions and the possibility of being tied up in paperwork etc.
I had been toying with the idea of claiming for number of years and have probably missed the boat on bank charges now, but decided to give it a go with my Egg account, which they closed with me owing approx 5.5k, causing me to take up a loan to clear it.
I collected all the dat together for a cc charges reclaim and found it only totalled £176, so though it might not be worth the time, hassle etc. My wife suggested PPI which I had cancelled during the time I held the card.
I looked through the old statements and found I had paid approx £1200.
I filled in the FOS questionnaire and sent it off last Tuesday (10/08/10) On Friday 13th, I received a reply thanking me for my letter and informing me that it had been passed to the complaints team for further investigation.
As I had applied for the card online, and Martin's guide suggests they like to wriggle out of these as you can see all T&Cs, I was expecting the brush off.
However, yesterday, I received a letter from the complaints team offering a full refund plus interest at 8%, totalling £2000!
I'm not sure how they found more charges than I asked for, but I'll take it!
This is a fab first result as far as I'm concerned, and while I won't fall into the trap of thinking its always this easy, I will certainly join the fight for my rights with enthusiasm from now on!

Totally agree with Di.
The FLA are a waste of space. You would get more response by going to talk to the ducks down in the local park.
I wrote 2 letters to them last year complaining about the way that Citi Cards had treated me and they took 2 months to respond and then lost my original letter.
They are there in name only and have no power of redress. They are more like an 'old boys club' just there to pretend they are protecting the consumer but there interests really lie with the banks.0
