    Hi everyone hope you are all well.
    Please can anyone tell me how far back you can claim and what the relevant acts, laws and reasons are for this. I have read Wendy's points re how far back, but I am still confused as to whether you can go back to the start (96 in my case) if the other factors are met. I am trying to reclaim all my PPI premiums made on my LTSB credit card and I am having conflicting statements from the LTSB 'advisors' that I am talking to. This is my first time trying to reclaim anything so I want to get it right.


    I have been unable to work since Dec 1980 due to ill-health, so I would not be able to claim for reasons of not being employed, pre-existing medical conditions and also, because it was the first credit card (I received a ' you have been pre-approved form) I ever took out and didn't know what ppi ( or whatever it was called then) was, I went into a local branch of LTSB (my usual bank) and asked one of the counter staff about it. I told her I was not working and the card would be mine, was asked if my husband was, said yes and was told that the card would be covered, even though my husband has never been on the card in any way, shape or form. In a phone call to LTSB 2 weeks ago they more or less admitted that I hadn't been covered. They are now telling me that it is illegal for them to keep statements after 6 years and it would only be possible to find the information regarding how much I have paid in premiums from the statements. I need to know if they are trying to pull a fast one because they can tell me other things regarding the account from prior to 2001 but not how much I have paid. I will be grateful for any and all info as I am expecting a phone call from their 'CONCERNS DEPT' and I don't want them to bully me over this.

    I was also told today that the banks are obligated BY LAW to destroy statements after 6 years, I thought that they were obligated to keep them for at least 6 years, who is right?

    I hope this has made it evident what I need and not just been a ramble. Thank you.

    I contacted FOS today to ask when the 8 weeks is up for First Plus to reply with Final Response letter, they told me 8 weeks from original complaint which was Aug 07'. I then phoned F Plus who told me they hadn't sent their Final Response letter yet, so I have told them they have 7 days to reply or the FOS are taking over. She assured me the letter would be with me by then. I will let you know how I get on, but don't let the b*ggers grind you down. Good luck :hello:

    LTSB are great ones for claiming time barred and trying to fob you off to the FOS knowing that you wont get anywhere with the FOS. NO banks are not obligated to destroy statement after 6 years. boy oh boy the person you had had obviously just finished a training course on fobbing off.

    when was the last point of contact for the card? its 6 years from that date. if still ongoing request a copy of the credit agreement (this will cost you the princely sum of £1.00) go one step better and apply for a SARs. this will cost you £10 but they HAVE to provide you will every last detail they are holding on you, including transcripts of converstations, stuff that they have put on microthingy, stuff they have put in archive. if they dont provide it then they HAVE to explain why. and they wont be able to use the excuse that it's statue to destroy after 6 years. they may retract and tell you that it is THEIR policy to destroy after 6 years, in which case request a copy of this so called policy. if they try this rubbish again after a SARs request it's non compliance on their part, report them to the information commissioners officer and take them to court and get the judge to force them to provide the stuff.

    the other point when they try to use the time barred argument is that you can get them under the mis representation act (if this was the case of course). this negates their argument because the time is counted from the time you realised/became aware of the misselling NOT the time the contract was signed.

    no templates on this site i dont think for the CCA and SAR's request. pm me if you need, and i will point you in the right direction.

    I contacted FOS today to ask when the 8 weeks is up for First Plus to reply with Final Response letter, they told me 8 weeks from original complaint which was Aug 07'. I then phoned F Plus who told me they hadn't sent their Final Response letter yet, so I have told them they have 7 days to reply or the FOS are taking over. She assured me the letter would be with me by then. I will let you know how I get on, but don't let the b*ggers grind you down. Good luck :hello:

    I am right in thinking then that you dealt directly with FirstPlus not a broker I have had no contact with FirstPlus just Central Capital or Trust as they are now known, wonder if I would have any better luck going through FirstPlus then? you have me thinking now although from previous posts on this site I thought they might direct me to Central Trust as they were my starting point. Um Um Um maybe I will just wrire to everyone bombard them with letters until they can't stand any more of me and give in. Keep me posted with you and I will keep you posted with me.
    Claimed back almost £4000 so far from HSBC for mis-sold PPI
    £2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.

    Thank you Shirley Cross, the card is still in use and still has a balance owing on it. I am also going to tell them that I want what is owing in a cheque and NOT taken off the balance on the card. I have only become aware that it was mis-sold and that you can claim since ST. Martin (bless him) has informed us all of this, via this wonderful site.

  • I took out my Nationwide mortgage with my husband 8 years ago. We were told at the time that we had to take out their own PPI if we wanted insurance as it was not available to buy elsewhere.

    After a year and a half of taking out the mortgage, I was made redundant and claimed on the PPI for about 8 months I think.

    Can I still reclaim the other 7 years worth of payments I've made? I've just found cheaper MPPI with another company and saved £30/month! It's not widely known that you can buy MPPI elsewhere, unlike car and home insurance.

    Any advice would be greatly appreciated.
