Just to update and hopefully get some more advice.
Sent letter off to Paragon on Friday and received speedy response today.
Basically the say that Central Capital were the brokers for the loan and they dealt with all the paperwork so I cannot claim from paragon.
Where do I go from here? Do I persue with Paragon or Central capital.
I would really appreciate any advice as I am very unsure about what to do next.
Cheers
Copy the same letter to Central Capital they have to abide by same guidelines!0 -

BMT76 - Thanks for the update since I'm also going to be writing to Paragon today. It's good to know that they replied quickly.
rayday2 - Thanks for your response to BMT76 as now I know exactly what to do when I receive my letter back from Paragon.
Thanks again both0 -
Hi all,
Could anybody advise me on the best strategy for my case?
I am one of those for who “Money” is a plane flying at high altitude above my head, if you see what I mean.
I arrived in UK two years ago and took a loan with HSBC. Without banking history the loans available were not numerous so I took more or less the only one available (or I though at the moment). I have the bad feeling I have been slightly stupid.
The amount of the loan was £6,000 (APR 14.9% - yehhh I know!!!) and I contracted insurance with the loan £1,020 (APR 14.9%). I perfectly remember asking if it was necessary and the agent telling me that they would not lend me the money without this protection.
I am at half way (18 of 36 months) of repaying a total amount of principal loan (£ 7,381.44 ) and personal loan protection plan of £1,254.83.
Thanks in advance0 -
I have found that Halifax Bank which I have been writing to since 4/08 this year is refusing anything and has not replied to the second template letter which was requiring reply within 14 days so we have had to apply to the Ombudsman - Halifax, when sorted will with their apparent attitude to these matters not only lose credit card services but 3 seperate bank accounts we both hold with them
What I would like to know is why when my wife is so visibly disabled she was charged PPI she was never asked her employment status which has been unemployed for over 20 years although a housewife, no nasty comments but does that count as paid employment? They knew she was in receipt of tax rebates each year, and most annoying of all was that it was OUR LOCAL branch that did the application in Oldham0 -
I sent a second letter to yes car credit/direct auto finance asking for my ppi back. they said they werent fsa authorised at the time i got the car so the ombudsman cant do anything even if i did contact them, is this true?? also ive read elsewhere that the mechanical breakdown insurance they made me take can be claimed back too, can i? Heres the letter thay sent to me below, ive highlighted the bit about fsa at the bottom, any advice on my next step would be much appreciated.FROM YCC:We have set out our position in this matter and have responded to your previous correspondence.
However to clarify the following points raised we would again, confirm as follows:-
1. you have provided no particulars of the conversations, which are alleged to have taken place.
2. you have only raised these issues several years later.
3. you signed documentation stating that the insurance products were optional.
Your position is not supported by evidence. we have no reason to believe that our standard procedures were not followed at the time the agreement was entered into. our position is borne out by the documents signed by you.
It remains your perogative to take whatever action you feel necessary, if you still feel pursuit of a 'claim' is warrented. we have responded to your correspondence and will now close your file. however, please note that this agreement with our company started on 15th october 2003 and therefore, occured before we were FSA authorised. it is our understanding that this therefore falls outside the jurisdiction of the financial ombudsman service.
This is a Fob-Off letter. I had the EXACT same one from them down to the very last word. I suspect from what I have read and researched that they are correct regarding the FOS not having jurisdiction over this and I have appealed to MSE team to help us find out who does so fingers crossed.
I am exceptionally angry about DAF and YCC and will be taking them to court over this if I cannot find out who regulated them to deal with it amicably as they did exactly the same thing to me and 1000's of other customers over telling me the PPI was compulsory which as far as I am concerned is immoral and fraudulent.
Good luck and keep us posted0 -
Billy Blagg you have answered your own question you have been sold PPI insurance by ticking the box and the PPI insurance sounds like it has been mis-sold but thats for you to decide and then claim back. Use all the templates on here to claim it back. :money::money:
Thanks for your reply Sarah (page 25) but I think you misunderstood my point. I have already claimed using the forms on site and the company said they are 'checking their phone records'.
I was asking why they are checking them and what do they expect to find? Let's say for example they find a call with me being asked 'Do I want PPI?' and I say 'Yes, of course' (can't see it but I'm playing Devil's Advocate here). Is this being 'mis-sold'? I would say yes but would this stand up legally or via the Ombudsman?
I'll chase this as far as it goes - much as I admire Martin I have been bugging banks and other companies for years prior to this site, so I am used to this - I'm simply trying to figure out where the company are going with this and what they hope to achieve.
I've already replied this week informing them that what was said or not on the telephone is inmaterial (I'm not even sure I ever spoke to them on the phone) as they should have warned me I would not be eligible for payment as a self-employed person but i'm keen to find out if anyone has had this dodge tactic or if this a bona-fide legal reason for refusing.0
