Please excuse me if this has already been answered but is there a time limit to how far back you can claim on misold PPI's? off to read the rest of the article. there's so much on this site, it's wonderful i'm telling everyone!
  • Hi

Looking for help with PPI claims. I have sent all my PPI claims off (4 in total). I am looking for an address for GE Capital for my mum, as she can't find any paperwork relating to a loan that she had with them.

    Many thanks

    Taken off site

Decide from this list which is most relevant to your situation:
    • If your policy started in the last six years, whether you’re still using it or not: Reclaim and ask your lender for a copy of the paperwork if you no longer have it.
    • If your policy started over six years ago and you are either still using it, or it ended within the last six years: Reclaim and ask your lender for a copy of the paperwork if you no longer have it. Your chances of success may be reduced if you have been aware of the mis-selling for some time, you have already complained or your account is very old.
    • If your policy ended over six years ago and you have the paperwork: Reclaim, although your chances of success are reduced, as it will depend on what you can remember about the sale.
    • If your policy ended over six years ago and you do not have the paperwork: Do not start a reclaim. As lenders only have to keep records for six years, if no one has a record of the contract a reclaim is unlikely to be sucessful

First of all Tiggrae mis quoted it should have been "In all genuine case's where halifax knows it can't win it waits till it gets to court then pays up immediately". There is a thread about HBOS claims on this website which you might want to look at but at the moment the average is nearly always a win (although haven't heard of anyone losing yet). Phone the FOS and ask when the Halifax became subscribed to the FOS if not there is a chance they were subscribed to the FLA check both out. You can always go to court but most like to leave it to the final option as the FOS and FLA can work out how much you should receive however if you go to court you will have to pay out costs and have to work out how much you want back.

Hi m.colak. Can you direct me to the HBOS thread you mentioned? Sorry if thats a daft question. Thanks. :T

  • Hi,

    Unsure what to do.

Loan 1 - A&L taken out in 2001 with PPI
Loan 2 - A&L taken out in 2003 with PPI
Loan 3 - A&L taken out in 2004 with PPI
Loan 4 - HFC Bank taken out in 2002 with PPI
Loan 5 - HFC Bank taken out in 2004 with PPI

All the above loans have been settled early. Unsure if i should claim PPI back or not. Looking back i didn't need PPI, i had a very stable job and was living with parents so i had no outgoings anyway such as rent, mortgage etc. But was young and silly and therefore thought it was essetial that i had PPI and i don't feel i probably understood what i was being sold..........just agreed to get the money.

Unfortunatley, when i settled the accounts i destroyed all details............

What shall i do? all 3 A&L lons where for about £5k each and the HFC loans where for about £2k each

HELP!! thought of going to court scares me and is making me reluctant at starting the whole process

Its not how long ago your policy was started it's when it finished ie in the last 6 years in the area you reclaim.

Two methods if you have old bank statements with the loan account numbers then send of to the relevant head offices for copies of the CCA (customer credit agreements) ensure you give a time limit as in the bank charges reclaim letters and follow up with a complaint to the information commisioner if they don't play ball. From this information you should get a rough idea how much your loan was .. how many payments you made ... and your settlement figures. With this ammo you can work out how much you should have refunded.

hi all. would like to know if any one has the aswer for this. I have a loan with northern rock and have ppi, after reading this site i called and asked to cancal. They said i would need a new credit check on me to do this, as it would be like taking a new loan out. Sounds fishie to me, Please help

You don't need a credit check as you are not asking for a new loan to cover the old one. Banks try and trick customers into this to reduce the "Refund" (rubbish) that they give you and then increase the hike on the new rate of interest and charge. Don't let them do this cancelling the PPI requires them to recalculate the payments and give them a lot of work.
