    Second letter sent off today,(Recorded of course,wouldn`t like to give them the opportunity to say they never received it!)Hope to reclaim the PPI from them,insurance that I never even signed for!!

    How do you rate my chances?

    The repayment for the insurance over seven years is a whopping £9,947.28:eek:

    Your chances are as good as your case for mis selling. Because it is close to 10k i expect the halifax to fight this one mate so it probably would be worth going via the FOS on this one (unless you very confident for court). The fees from MCOL might be quite steep as well poss upwards of £250 (you can claim this back from halifax if you win).

    Sounds like a definant stop at the information comissioners office and possibly get the FSA involved as it sounds like bad practice is being carried out here. Hope this helps.

    It's been more than 8 weeks, so i sent the 2nd letter and they just fobbed me off saying another department was dealing with it, and sent me copies of all the letters i had had fobbing me off (with no address on to write to that department!) it is sooo frustrating!!!

    Well this is the time to say enough is enough and take the claim further either via the FOS or by Court only you can make the decision which one though. If you go via the FOS you can always fall back on the court option.

    Many thanks,I suppose I wait to hear back from Halifax before going via the FOS...Is this a relatively easy process...?

  • My husband and I took out a loan 4 and a half years ago with Alliance & Leicester. At this time we also took out the PPI. After hearing Martin on Radio 1, I came to this website, had a read and then checked my loan paperwork when I got home.

    Having looked through all the paperwork I noticed that only I was covered on the PPI when my husband should also have been on there.

    I wrote to A&L using Martins template and I had a quick response saying that in my case they did not believe there was a problem and that in this instance the advisor had told me to read through the paperwork once received. I then wrote back to them asking for a audio copy of the conversation that they refer to.

    In about 10 days I had a further letter from them saying that - in no admission of any wrong doing - they would be cancelling the PPI policy and sending me a cheque for over £2000.00 for all the payments made to date.

    Result! So I wonder what telephone conversation they were referring to that they obviously did not have a copy of?!

    Moral of this - if at first you dont succeed....... Also, I sent all correspondence by special delivery. It isn't cheap, but the £11.00 odd I spent on post has been well spent.:j

    I was also wondering if I should have been covered too as both our names are on the title deeds to our property but only my husbands appear on the loan....At the moment Iam trying to get them for PPI that neither of us signed for,also we are self employed...Food for thought...Do you have any idea if both our names should have been on the Homeowner loan....

    Thanks for your letter dated 20 December 2007, Reference Number CRXXXX
    Your replay states that I phoned on 5 January 2007 at 4.35 pm and my card was activated and that I was enrolled on the optional Payment Break Plan. I have had this card from Dec 2005 and been paying Payment Break Plan every month from then. I have statements dated before then showing that I have been paying Payment Break Plan. Can I have a copy of the transcript of this call, as I don’t believe this is what happened during the phone call?
    I signed up for this card in a shopping center In Solihull in December 2005. I remember signing up, and remember being there for all of a few minutes. Your sales representative did not explain to me that this was an optional extra, and I did not know I was paying it. It was only when all this PPI has been covered in the press that I looked into my account, and noticed that I was paying a Payment Break Plan. You have stated that this is not insurance, and therefore not subject to the GISC private code. I still feel that your sales representative miss informed me, and I that I was negligently misrepresented and as such under the 1977 Misrepresentation Act the onus is upon you to prove otherwise.
    Unless you can prove otherwise, I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
    I look forward to a full and prompt response to this letter and for the matter to be concluded with eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.
