Hi new to this!!!
Looking for some sound and detailed advice please!
I have:
Loan from HSBC 1037
Career Development Loan Barclays 8000 (Don't Pay Back Until 2009)
HFC Bank, Dell and GE Bank to finance PS3,Computer,Laptop,CD Player
Black Horse - Financing Bed
Can I claim back on all of these? How do I do this? Do I have to phone or send letter?

Stop breath in feel better....ok. First of all had three loans with black horse each time settling with another loan. Guess what you check you're policy documents and claim back the PPI on each loan individually never believe the bank as all there after is generate more money. Check the statements and start reclaiming now.0

I do have a statement dating before the 5th and has charged me Payment Break Plan. So it looks like Monument are holding data about me that is not correct. Am i legally able to obtain a copy of this conversation i had with them, Also am I able to get a copy of the initial contract I signed. Am i able to use the data protection act to request all data they hold on me as i expect it to be wrong?
Would it be worth writing another letter saying that I have been paying Payment Break Plan cover before I enrolled on it?
Any ideas, tips will be greatfully accepted.

I am in the process of reclaiming PPI on a Barclayloan - the second letter has gone off and they will reply by 7th February. However I am not sure what sort of refund would be due to me. The loan was over 6 years and PPI was approx £2500. It was a single premium policy, so with interest was £3,919. The loan was cancelled with about 2 years to go - I never got any form of PPI refund at that stage. They mis sold as i was told that the credit may be rejected if i didnt take the ppi. Do i get the ppi of £3919 plus the 8%, or does it have something to do with when it got cancelled. I dont want then to give me a low ball offer and not have a rough idea of what i should be getting in reality. Thank you.0

Any loans or credit agreements (CCA) that you have with any company where they have charged you PPI falsely you can claim back be it sofa's tv etc. The template letters are in the reclaim PPI section of the main forum. Always send registered letters and normal letters can be misplaced and phone calls can be ignored.0 -

The only reason i recommend the court route is due to the length of time t can take through the FOS although if the loan was before 2004 then they weren't covered and you have to try a body like the FLA. You can use martin's 8% statuatory calculator in any of the charge reclaim sections to work out the interest you should receive back (you have to do it for every payment you made). The downside of the court system is that you have to work out how much you want and there is no chance of compo unless you can prove gross misselling. The FOS usually can sort out compo and additional interest.0 -

A payment break plan is an extra premium some company will take so that if you have a bad month then you can take a payment break with no financial penalties. I very much doubt you can claim this back but there is no reason you can if you check the terms and conditions and it says it optional and you felt pressurised it amounts to the same thing misselling again and use the same templates for PPI but amend them for the payment break.0 -
Katiekittykat if you claim is within the 8 week period then you will have to wait unfortunately. Once it is beyond this you can start taking affirmative action whether its the FOS or Court is your decision.
It's been more than 8 weeks, so i sent the 2nd letter and they just fobbed me off saying another department was dealing with it, and sent me copies of all the letters i had had fobbing me off (with no address on to write to that department!) it is sooo frustrating!!!Friends are angels who lift us to our feet when our wings have trouble remembering how to fly.0 -

Take your settlement figure and add the payments you made. Take this figure away from the loan+charge and this gives you the lowest figure you could receive. However there is nothing stopping reclaiming the whole amount but you may have to fight for it.0 -
I guess you have spoken to then and requested one. If not this is your first step. If they are unwilling or will not provide such statement inform the information commisioner whom can enforce the company to supply said paperwork or heavily fine them. He can also provide advice where to go next if they still will not provide the information.0
