  • Are there any different things to consider when you had selected PPI on an application form by tick box? Are they supposed to follow up with a phone call as information was minimal on the form and I am not even sure it was my tick in the box to be honest. Any hints???
  • Hi all
    I wrote to RBS last year (using the first letter) as I believed that I had been missold PPI on three consecutive loans from them (all now paid off). In the letter I identified the loans by credit agreement number.

    I received three holding letters, over a period of weeks, saying that they were looking into it.

    Today, 9 weeks later (and one week after the 8 week deadline I gave them), I've received a letter saying that I did not provide them with enough information and I need to give them the account numbers and sort codes for the loan accounts, otherwise there will be further delay. I can't believe that they can't look up the accounts using their own credit agreement numbers.

    Should I just go straight to letter 2? What do people think, some advice would be gratefully received.

    First of all have they sent you a letter saying this was either compensation or this was in final settlement to the PPI. If not this doesn't affect you're rights to reclaim more from them. Remember to quote the figures and state in your letter you intend to claim the full amount, if necessary through court, and aknowledge that you have had two payments from them but you still expect x amount. Quote the misrepresentation Act of 1967 especially relating to the section under misselling. This makes it their responsibility to prove that they didn't mis sell not that its your word against theirs. Hope this helps.

    The tick box is the companies usually attempt at a get out clause saying well you ticked the box therefore you wanted/needed it. I have been down this line with a few companies myself and said just because i ticked a box doesn't mean i give you permission to rip me off. You are in a better position than most as it sounds like the PPI was never explained to you and instead was added on the basis of a form rather than an interview. Try using that tact.

    Right first of all the letters that you sent should have contained wording like you have 14 days to respond. Defining an deadline. Now check the holding letters did they at anytime in the wording saying that it was being investigated. If so they can't claim more time or deflect the fault to you as if it was investigated they would have discovered this earlier. I would now include all information they require giving them a set deadline of 14 days. The final paragraph should go something like this...

    If i have not heard from you within the said 14 days i intend to take legal advice as in to take my case to either the FOS or County Court (Small Claims) route. I am sure that they will both find in my favour as your recent correspondance shows that you have not dealt with my complaint effectively or given it the attention it needed.

    ...Words to that effect. Hope this helps.

    First of all your terms and conditions of your loan will contain all the information pertaining to the PPI element of the loan. If it doesn't then this either shows that the company is neglegant or the PPI was provided by another company. This is to stop you chasing after the wrong company and wasting valuable time in the process.

    Write and ask what percentage you paid upon early redemption - the FSA have stated

    Hi thanks for trying to help, Basically the letters they sent out to us say that the monies "represents the rebate of your payment protection insurance". I do not know any figures or how much they charged for the PPI in the first place, just that the loan was for £30,000, so I dont know how much to claim.
    Any Ideas please.
  • Hi any help out there before I go to my next stage

    Claiming from barclays for mis-sold PPI alongside mortgage , threatened FOS last week, received response this morning saying past 6 years, no paperwork has been kept coz of time span.

    Got all paperwork ready for FOS, is this best route to take or court, Tiggrae suggested misrepresentation act 1967 route, not used this at all in correspondence to bank, can I send further letter giving the threat of court action or is this the final letter to bank and I should now move on to FOS as I have already had response to from barclays telling me to do so.:confused:

    ANY HELP GREATFULLY APPRECIATED !!!!!!
