    Strange as its one of the most popular forums in the uk. It helps countless people, including me, get out of debt. It is full of helpful, knowledgeable people who are generous with their time and advice.

    Tens of thousands of people somehow manage to post on here without getting into a fight with the other posters, it incredible, i wonder how they do it.......? This forum, like life, ime, tends to be a two way street kind of deal.

    I'm sorry that you find this forum sad, i dont, i wish you well in your search for somewhere more fulfilling.

    I am humble enough to ask for help on issue,s in which I have no knowledge but am not stupid enough to pander to self important people who can not answer a simple question but instead post in an aggressive , unknowledgeable and domineering way . Found the answer elsewhere a few day,s ago and have requested a copy of my agreement which will tell me fact,s WHEN SIGNED , HOW BROKER WAS PAID eg WAS IT BY LOAN COMPANY OR ME , WHICH AGREEMENT WAS SIGNED DID IT SHOW ALL THE INFORMATION PERTAINING TO THE LOAN . I know that it is,nt easy but there are people who are facing after loan finishes stupid amount,s of money still to pay , mine is ok bit tight to pay and if I can help other,s and me by testing the water I,ll give it a go . It will take a while and I will post findings that can help other,s . You have been most entertaining speak soon

    Facts we do NOT know but need to.

    • When the loan was sold (this will determine whether the Consumer Credit Act 2006 applies).
    • Whether the broker was acting as agent for the OP or the lender (if the former then there would not normally be any liability on the part of the lender).
    • Whether the OP paid a fee to the broker. (This could give rise to a claim for a secret commission - although in itself that would only normally result in a claim for a refund of the commission plus interest and would be independent of whether the loan itself was missold).
    • Whether any such fee was added to the loan (that might enable a claim against the lender under section 75 of the Consumer Credit Act 1974).
    • Who the lender is.
    • Why the OP actually thinks the loan is missold.

    The OP's original question was is the lender liable.

    Given that, if the OP wants to make such an assertion, it is for him to prove it is more likely than not (and not simply equally likely) that the assertion is true, I am going to conclude that on the basis of the evidence they have told us of (i.e. nothing) the lender is not liable.

    Aiki, no one here has trolled you, we've just pointed out, several times, that you haven't given us enough information for us to be able to help you properly.

    I understand that you must feel frustrated and that's why you're lashing out. I hope you're able to resolve matters with the loan provider and maybe get a good night's sleep.
