Rights to returning a smartphone bought online

    if you were not clear on whether they would take it back why did you post it back to them before getting something in writing from them?

    Hi, some retailers do sell returned phones as clearance bargains and as such probably lose out financially however Very do not sell clearance goods, everything is sold is brand new, you have returned a phone that has the seal broken so it is no longer brand new.

    If the phone was faulty you would be entitled to a repair or possibly a refund within in the first few days however you cannot just change your mind because you don't like it.

    The Law says otherwise. Equally, the Law (new version) provides a means for retailers to recoup any losses caused by this. :)

    Hello everyone and thank you for all your responses.

    Very received the phone on Monday and have today refunded me the full amount but £3.95. I am not sure what this is for, but I have asked them to advise me and then relay this back to you all if anyone is interested.

    It seems you can return a phone bought online (reason seemingly irrelevant as nobody from Very asked me) and get a refund. If £3.95 is the charge for opening the box and switching it on I think that is fair enough.

    I forgot to add in my original post and in relation to conversation about breaking the box seal; the person I spoke to from Very when enquiring about the return, said it was perfectly fine to open the box (i.e. break the seal) the concern they had was that the phone had been switched on.

    I will try and get some kind of report or set of standards from very regarding this matter and post ot back to you all.

    I didn't really think of that as an issue to be honest. Besides, they had to see the phone in order to make a decision?

    It didn't say anything along the lines of 'you cant switch the phone on in order to return it'.

    Also, no, there was no big red sticker or even a 'seal' sticker. The box was just covered in a plastic wrapper. if you look online, you can search what an unopened HTC box looks like...

    Did you break any seal on the box?
    If so, this may be the deal breaker.

    Turning the phone on/off won't be. However if you skipped through the setup and had a play, then when they turn it on, it won't ask them about setting up accounts.
    However if you reset the phone, then the next time it is turned on, it'll ask you to set up the phone properly.
    Granted, very.co.uk could just do this but the first mistake was buying from them to begin with :P

    Thank you for this, however, when speaking to very, they specifically said it was fine to open the box, their concern was switching the phone on.

    £3.95 is Very's standard delivery cost so it makes sense that they wouldn't refund that bit.

    I'm slightly surprised that you have been refunded in full, but am happy to be proved wrong. Well done!

    Did Very cover the returns cost? If yes then keeping the £3.95 is reasonable; If no then they are obliged to refund the initial postage too.
