If the Council turn down PP, then you can always appeal their decision. This will place your PP in the hands of a Govt. inspector who will decide the PP without even visiting the site.Never Knowingly Understood.

To be perfectly honest, that means your business plan isn't viable, for you, where you are.
It's not the council's problem.
Then you aren't looking in the right parts of the country. Again, that just means that your business plan isn't viable for you, because you can't relocate to somewhere where you can buy the property you need at a price that's viable.

Think about that for a minute. Think about the reasons why the green belts were established. As somebody who wants to get into an agricultural business, you must be able to understand them better than somebody thinking purely from a residential p-o-v, so you should be thankful that the council's hot on protecting the green belt.
My business plan is viable fact, but not while council are making barriers.
I am well aware of what i have to do to justify a house on greenbelt land that is not a problem.
The council have refused to give me a business address even though i am entitled to one.
First excuse its not residential
2nd one wait and see if planning gets passed.
Despite fact i am entitled to one as business is based here.

Ok send valuation officer around i will be exempt as a small bis and ratable value anyway , they still wont give me a address.
Wont reply to emails and are selective with the facts.
I do not doubt for one mini will be taking them to the cleaners but i want to give them enough rope to hang themselves.
I would be quite happy to see what planning inspector makes of it all.
Thing is the council are not giving me a level playing field.
My best option is get the 5 hectres put in for barn and tempory permission for mobile home while i build it.
Bis will be well viable by then .
Sorry but your opinion of councils is slighty different to mine i would not give them time of day dispite trying with this one.
Previous dealings i ran a diy/garden centre started it from scratch few years later got chance of 11 acres in process of signing papers solicitor said ring council to see if they will let you put garden centre on it.
Cut it short they said no chance its just in green belt i pulled out.
Council bought it and built a cremitorium on it.
Last dealing i had i worked for a council had a industrial accident they tried to sack me

I think the advice is obvious.
If the OP is so sure they are being victimised, they should carry on with the business and comply with the enforcement notice as fully as they can. There is no other option, except giving up.
Enforcement notices in a general sense are not uncommon. I know someone who's had several. The processes of further negotiation and appeal etc take ages, and meanwhile he's been getting on with his life.
Yes, council officials can be pretty useless, especially when they stray into unfamiliar territory, but then so can others, like architects or builders. Incompetence isn't something they have an exclusive right to. They may have more 'powers,' but these can be challenged.
All the above in acknowledgment that we are only getting one side of the story here, as usual.0 -
If you have to caveat reality to get to viability, then you're in denial. Sorry, but...
The viability test gives people the right for residential use in green belt like it or not.
You need to generate approx £14-16k income and have a work load requireing 38 hours work. and justify a need to be on site.
Being as i am privy to my accounts i find it most amusing that a council that can not balance its books are telling me whats viable... lol
I have friends running similar operations do people really not think i have done my home work re the viability side?
I will appeal the enforcement notice
1.On the grounds its not residential use
2 The council are being heavy handed
3 No effort to reach a compromise dispite my efforts
4 Thier refusal to respond to questions relating to what i need permission
for and let the planning inspector come out on site and reach his own conclusions.0 -
Just spoken to the previous owner used store room for eating ,cooking,had soffa in it wardrobes ,tables for 8 years prior to my 2 years.
A lot depends on how the council want to define residential now
Its 4 years to be classed as lawful for residential use ?
10 years for change of use ?
Bit that gets me is insistance i remove so called residential items, previous owner left those here anyway.
Just rang four different council planning departments and none could define what would be classed as residential all said its a grey area lol.
I asked if i had a store room attached to stables would i be allowed a cooker ,table,chairs,soffa , cook and eat onsite ect.
Three said yes as long as horses were on site. But if there were no animals it would be deffinate no.
Other said he needed to look into each individual case.
All said if horse was ill or foaling you would be able to be on site and sleep.0 -
Well the appeals in, got some great help from another forum.
Council were not expecing the statements from the previous owners

Well 18 months after the start the planning inspector made his visit on the 5th Jan for enforcement appeal.
Enforcement officer arrives in shoes after all this rain sums council up perfectly, planning inspector could not believe it.
Timing was great just as kidding is starting, went great from my angle
Council never made a comment even when asked, could not walk around the shelters due to mud and only having shoes..lol
Planning inspector went round everywhere, enforcement officer looked hissed off when he saw all CTTV cameras.
Should get inspectors decision in 21 days0 -
