For the small claims track, which this would be, you can't claim your expenses.
I thought you could if the claimant acts unreasonably - I have no relevant experience but presumably you would have a good chance of demonstrating that someone pursuing you for their costs in chasing you for an debt that you had never actually owed to them in the first place was acting unreasonably by pursing the claim and forcing you to defend yourself and this incur costs; although obviously if anyone deliberately and unreasonably ran up costs of £10,000 just to try to claim them back from an unreasonable claimant there is also quite a good chance that the judge will tell them to shove their application for costs where the sun doesn't shine.0 -

It is true that the court has discretion to award costs in the small claims track, but in practice that never happens, apart from the court fees and a rather small amount for the fixed costs of preparing a case. In any case, it would not be reasonable to spend a large amount defending your case of £200, so the discretionary costs would, even if you got them, be relatively small.
Apart from that, we have not heard the Full story. It may well be that the debt collectors were instructed before the debt was paid. In that case, The debt collection costs may have been reasonably incurred and need to be paid. The debt relates to the property, and the fact that it was incurred before the property was bought is irrelevant.
It would be possible to just wait until the freeholder tries to issue court proceedings for the £200 debt, but therein lies the route to stress and an early death.
I'm reasonably sure that silvercar does not have any liability for this payment, and it probably lies with the vendor, but the professional costs involved in sorting it out are more than £200.No reliance should be placed on the above! Absolutely none, do you hear?0 -
Well, I am looking forward to November. This month we lost two family friends, one closer to fir, one less close to me, but that people said I was quite like. My infections are clearing up, and I honestly had no idea my chest was so bad. Goes to show, not all cheat infections are 'productive': I had begun to wonder if I was allergic to the cats now, or was getting late onset asthma, but I think its all been chest infection. I'm not sure its entirely cleared on the antibiotics, but its DRAMATICALLY better! I really had not noticed how much my breath had become compromised. That's the problem, I guess, in compromised lifestyle its easy to accept the fade and not notice its something else.
I am so glad that it doesn't look like I am allergic to my cats.
. Its not like they would be going anywhere anyway,
Hopefully we can get through November with no one popping their clogs though.

Good to hear you are on the mend. We had a scare with DD2 who got a bit fluey and by the next night was in hospital with very low o2 sat but thankfully 48 hours later all was well again.
How is the house, are you and FIR going to keep warm enough this winter?I think....0 -
House is toasty thanks michaels. We have had the hearing on a couple of times certainly, but if the heating is on in the evening its too hot at night. So just whacking it on if its not warm in the house. Using the cheese room woodstove a fair bit, that keeps that whole side of the house VERY warm very easily, even with the vaulted ceilings. It was a good move, even if I do slightly regret the open fire, this is much more practical. Ironically, all the new radiators are turned off at the moment when the heating is on, if the fire is lit...so the heating just does the old bit and the beds and bathroom. Very effectively. Its a good system.
. The house retains heat ok, now the fabric of it is warm, so we don't need it on a lot yet. I had it on for a day this week because of chest and feeling cold.....I think it was Sunday or Monday, then have not had it on since.

My events guys reckoned it's impossible to stuff/stamp/send out 500 envelopes in 10 hours.
Using exactly the same techniques as they use, I managed to get it done in just under 6 today.
Less talking is probably the key to it💙💛 💔0 -
All my plans went by the wayside today. We were supposed to be going to mum and dad's caravan to bring back all their stuff as they are giving up the van tomorrow, unfortunately, I think I ate something which didn't agree with me as I have been up all night with D & V.
Have now spent the entire day in bed, a rare luxury and something that would have been impossible usually but James is home for a few days and took up the slack/sorted youngest out.We made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.
Eldests' EDS diagnosis 4.5.10, mine 13.1.11 eekk - now having fun and games as a wheelchair user.0
