The second you link that product to that star the lawyers in the USA are straight on your back wanting big money, real big money.

Also other celebs have kindly given specific permission to say that they wear/endorse these items. Including one being filmed today!

I just checked this again. It was guaranteed to get onto the flight delivery service at 7pm for a UPS flight that would have arrived in NY next morning. Apologies for the confusion.

If the question is can you claim all the millions you lost in riches what you might have made as a designer, the answer is no.
Can you claim the cost of delivery back, well you will have to read the contract, I am sure they make sure that is covered somewhere.I do Contracts, all day every day.0 -

Any courier who has a clause in their contract saying they do not have to repay the fee if they fail to do what they were paid to do would be laughed out of court if they tried to use it as a defence.
Consumer contract terms have to be fair and they idea that anyone can have a contract term that essentially says: "If you pay us some money to do something we might do it but if we don't we're going to keep your money" is frankly ludicrous and it's a pity that ignorant posters on this forum keep asserting that such clauses exist (in many cases they don't for the company under discussion), and are enforceable.
The OP cannot claim for consequential loss because:
a) It is fair for a courier to exclude (or limit) liability for that as they would otherwise be opening themselves up to virtually unlimited liability for a relatively insignificant fee.
b) The OP's loss is not quantifiable.There are two types of people in the world: Those that can extrapolate information.0 -
UPS promised a refund by the end of the Thursday (the day of the complaint) but it was not paid by the end of day Friday.
No question about a refund for a 'next day service' not fulfilled on admission of their own error.
They are going to discuss some form of compensation but nothing makes up for a unique opportunity missed.

It might be worthwhile posting a question about suitable couriers on the ebay board.

Trade association for couriers. Maybe ring them, explain , they might be able to suggest a better service.0 -

Did you book this with UPS direct or got cheap through a reseller?0

If you booked the service with UPS directly they say 5pm collection is too late. 4:30 is the latest it can enter the UPS network. Also UPS make you print your own label to speed up the process. Infact reading my UPS account it says no paperwork from the driver is needed and not mailing with a label will cause delays.
So I have to say this is your fault. Fail to prepare prepare to fail0 -
