ASDA online overcharge on the day of delivery

    I am glad you benefited from ASDA's 'generosity' i doubt if an elderly person without the extra money in reserve you have would welcome an additional 200% levied against any item on their shopping list, when they have budgeted carefully with their pension.
    I believe these people want to trust these big supermarkets. And just accept the extra hardship it will undoubtedly be placing on them.
    Thats exactly why multi-nationals like ASDA have a responsibility to charge fairly, and not try to circumvent UK law with wooly and unlawful T&C's.

    Citizens Advice have been called before and people have been told that as it is in the t&c's and also clearly pointed out on confirmation emails that it is within the law.

    I seriously doubt that Sainsburys, Asda, Tesco and the like are all breaking the law and have been for years and never been challenged.

    Anyway lets leave it at that, you feel hard done by so at least now you know to never shop for groceries online unless you are prepared for the sometimes price increases.

    Yes I agree you should leave it there, as I am sure the CAB would clarify that ASDA are working in contradiction to established laws, especially when you have a conformation email and agreed prices.
    Just to remind you, why these supermarkets have not been challenged, is because no one wants to take ASDA to court as they probably have enough money just to forget it, and the people it really hits like the elderly, do not have the ability or resources to take them on, and thats why it continues.
    I for one will probably continue to purchase online, and bring this issue to ASDA's attention at every opportunity, and attempt to get redress where appropriate.
    Does anyone else feel the same way?

    You may be sure that the CAB would clarify that they are contradicting the law, I am telling you that they have said that they are not.

    I truly hope that when you get a 'good' sub from Asda that you turn it away stating that you wanted to pay x amount for x and that you are being given something that you don't want even if it benefits you.

    They would be 'obviously' breaking the law if you ordered 2 kilo of something for £10 and they delivered 3 kilo for £10, it works both ways.

    Yes I am certain they would confirm that the order conformation email would constitute a binding contract, and as such it is illegal to change the prices at the agreed delivery time. Otherwise I don't really understand your point.
    I also think that when ASDA employ people to defend their cases online, it is another very shrewd move.
    You are obviously very happy with their service to you, but when you are quaffing your wine and feasting on your 2 kilo joints of beef, you take a few minutes to reflect on those working class and elderly people you are happy to leave being overcharged for their essentials.

    The big red note under your name says 'be nice to newbies' - maybe it should give you a reminder to be nice as well rather than 9 posts of utter s**t you've ranted.

    Hundreds of thousands will accept these T&C's each week and shop in the knowledge of what they're doing but you're on a one (wo)man crusade to claim illegality.

    Go ahead and sue them - I'll watch with interest

    You are not entitled to pay the lower price. You may however be entitled to return non-perishable items and get the price you paid refunded. I don't know how ASDA would do this. With Tesco one can return items purchased online to a store for a refund. With Ocado it can be arranged for the driver to collect the unwanted item when making the next delivery.

    You have just said that the order confirmation email is binding, therefore you are also saying that where it clearly states on that exact email that it is a guide price is also binding which makes your whole post mute ;)

    No one is over charged for their essentials, you are charged the same as going into store on the day of delivery :cool:
