refund refused

Hi all,
my wife bought a top from superdry and tried it on when she got home, its a small and its too big. She took it back and asked for a refund but was told its not store policy as stated on the receipt, only an exchange or gift voucher can be provided. She stated these were not appropriate as she requires an extra small and they did not have that size but they still refused. They suggested she could use the gift voucher or something as a present.

I have said many times about trying it on in the shop before buying, it would save so much hastle :O

What can she do now?

    No entitlement to a refund as it was bought in store.

    Very much proves the point of trying it on in store.

    Not a lot. They are within their rights to refuse a refund.
  • Yep, they don't have to do anything. Entirely her own fault, maybe now she'll learn to try things on. :)

    She should take the gift voucher and give it as a present or sell on ebay.


    You have no rights to return an item that does not fit, most stores offer this as goodwill.

    Wrong!!!

    If it has been labeled with wrong size it has been described incorrectly and entitled then to a full refund

    Albeit proving it has been described wrongly maybe a matter for the court

    But this consumer certainly have the full weight of the law on their side (taking the post at face value)

    Why why why manufacturers don't put the actual size on ladies clothing is just a problem caused in favour of vanity
    When will the "Edit" and "Quote" button get fixed on the mobile web interface?

    The poster is challenging "the description" and proved right, they are entitled to refund no matter how/where/when they bought it

    They are not questioning the sizing. They are questioning the shop's returns policy ...... which is perfectly legal.
