As sizes are so different in different shops (and ranges within those shops in some cases), then there is no way that the purchaser could successfully challenge the description, unless an incorrect sizing label had been applied to the garment. This isn't the case here, and they should have tried it on before purchase. Your statement that they are 'entitled to a refund' is incorrect.0 -
Superdry sizes are weird at best. I'm a pretty standard size 14 up top but because I have a chest nothing in their ladies range fits me comfortably.
Daughter on the other hand is a size 8 and their small is too big.
Weird weird sizing and a shop that from experience you always have to try the clothing on before purchase.0 -

Might be best if you read the OP before you start talking about something that the thread wasn't even about.
and if you understood clothing - especially womens clothing you will know that sizing is always different between different brands and manufacturers.

If it has been labeled with wrong size it has been described incorrectly and entitled then to a full refund
Albeit proving it has been described wrongly maybe a matter for the court
But this consumer certainly have the full weight of the law on their side (taking the post at face value)
Why why why manufacturers don't put the actual size on ladies clothing is just a problem caused in favour of vanity
That would only be the case if the shop didnt offer fitting rooms.

If they do not have a clear display about their refunds policy BEFORE you make the purchase you can challenge them. It is not acceptable, by consumer law, to only have this policy displayed on receipts as you will have entered into the contract by the time you have the receipt.
Go back to the store & if they do not have appropriate notices outlining their returns policy then you can ask for a refund.Dwy galon, un dyhead,

You cannot give terms of contract to a party after the agreement has been made. The contract is entered into by both parties when money changes hands for goods/services & as a result if the only notice of a returns policy is on a receipt it is not allowing the consumer to make a fully informed choice on the matter. What oyu are mistaking is customers statutory rights in which they don't have one for a refund if bought in store.Dont rock the boat
