Travel agent can't even say sorry!

    From the information you've given I don't see how this was anything other than an accident.
    Whilst I appreciate your reply, you don't have all the facts...I tried to be brief as I wasn't sure it was the right place to put my 'vent' as there are strict rules on MSE. Plus no one wants to read a 10 page epic rant :)

    After an investigation that was the result and they had all the facts. You need to put this behind you and move on.

    So your mum fell over a table she wasn't expecting to be there... right?

    Was the table moving at the time?
    If not, then in all fairness, this appears to be an accident and no-one other than the injured party is to blame.

    Sometimes it simply isn't possible to blame someone else, and the responsibility has to be shouldered by the person making the mistake.

    Ok everyone, thanks for your replies, but they do seem to be going off track a little, especially with the last reply..moving table :))) not seen many if those... my original post was the non apology from a well known travel company , in regard to it taking 9 months to say it was an accident. It has been incredibly upsetting for my parents to go through this & after listening to my poor mum after getting this letter, I can tell you it wasn't nice.

    As blunt as it is no one forced your mother to walk that way. She could have requested it be moved back if it was in such a awkward position. Falling over a large object like a table which is obviously very visible and static will very rarely be the hotels problem.
  • I'm clearly missing something here. Did the travel insurance cover the cost of your mother's treatment for a fractured wrist? If they did (as they should have done), then why are you hanging on for an apology from the hotel/travel agent/holiday company?

    OK, perhaps it is reasonable to assume the table was static at the time of the incident.

    In which case, the only reason your mother walked into it was because she didn't see it. Why was that? Why do you think the hotel, holiday company, travel agent or insurance company should take responsibility for your mother not seeing the table? Why do you think any one of those organisations should apologise for your mother's mistake?

    Were you there, by the way?

    Like some of the other posters, I'm confused.

    How is a travel agency supposed to factor in your mother's inability to negotiate furniture?

    If they had misrepresented a 3* hotel as a 4*, told you that a destination was by the beach instead of in the mountains or that Paris Charles de Gaulle was very close to Palermo, then you have a case.

    An accident which occurred on hotel premises can't be held as the agency's responsibility.

    If your parents wish to take this further, tell them to contact their house insurer (if they have legal cover on their insurance) or a no win no fee solicitor.


    Only an expert can tell them if they have a case, once they have all the facts.
