After an investigation that was the result and they had all the facts. You need to put this behind you and move on.Lost my soulmate so life is empty.

So your mum fell over a table she wasn't expecting to be there... right?
Was the table moving at the time?
If not, then in all fairness, this appears to be an accident and no-one other than the injured party is to blame.
Sometimes it simply isn't possible to blame someone else, and the responsibility has to be shouldered by the person making the mistake.0 -

)) not seen many if those... my original post was the non apology from a well known travel company , in regard to it taking 9 months to say it was an accident. It has been incredibly upsetting for my parents to go through this & after listening to my poor mum after getting this letter, I can tell you it wasn't nice.

This is probably in the wrong forum but I am angry! My elderly parents went on holiday abroad last year which resulted in my mum fracturing her wrist 2 days into her holiday. All because the coffee table had been moved too close to the chair so my mum went around the corner straight into the table, fracturing her wrist when she fell. This was in June 2014. Travel ins didn't want to know...you need to speak to the hol company..they did...provided evidence, etc have been incredibly patient as it is now March 2015, all for the hol company to say no liability...it was an accident! Now I don't agree this is true, but ok if you accept this it sure doesn't explain why it has taken 9 months to get this conclusion...& they have done all the chasing...with them saying yeah it will be done within 6 months, yes by feb, ooh one more piece of evidence needed, a decision will be made by next week...hey ho letter came today. I feel disgusted that both the hotel & hol company think they cannot offer an apology to my parents whose holiday was totally ruined by this, but carried on with a mentally disabled daughter with them, as there was little more they could do. Again sorry this is prob in the wrong forum, but it said vent so I have!

As blunt as it is no one forced your mother to walk that way. She could have requested it be moved back if it was in such a awkward position. Falling over a large object like a table which is obviously very visible and static will very rarely be the hotels problem.0

I'm clearly missing something here. Did the travel insurance cover the cost of your mother's treatment for a fractured wrist? If they did (as they should have done), then why are you hanging on for an apology from the hotel/travel agent/holiday company?'Never argue with an idiot. In which case, the only reason your mother walked into it was because she didn't see it. Why was that? Why do you think the hotel, holiday company, travel agent or insurance company should take responsibility for your mother not seeing the table? Why do you think any one of those organisations should apologise for your mother's mistake?

Like some of the other posters, I'm confused.
How is a travel agency supposed to factor in your mother's inability to negotiate furniture?
If they had misrepresented a 3* hotel as a 4*, told you that a destination was by the beach instead of in the mountains or that Paris Charles de Gaulle was very close to Palermo, then you have a case.
An accident which occurred on hotel premises can't be held as the agency's responsibility.:huh: Don't know what I'm doing, but doing it anyway... :huh:0 -
If your parents wish to take this further, tell them to contact their house insurer (if they have legal cover on their insurance) or a no win no fee solicitor.
Only an expert can tell them if they have a case, once they have all the facts.
