Yes - You were advised to start ONE thread - and then you keep everything on it. Starting different threads for different questions/aspects relating to the same ticket is not going to help anyone to help!
And most of the basic/essential info relating to your ticket is on one of your thread hijacks - which is why you need to get it all moved to one place.0 -

now threads are merged and I have managed to confuse or upset a few users albeit unintentionally - do you think I should simply start again - worried that it will be quite a long post to explain my predicament fully

No stick to this one. Just post a clean post ( or alter your first one ) to show the following without any padding ( and when I say padding I mean we don't need to know the make of your car, what the weather was like or what colour pants you were wearing that day ) :

Apologies in advance for the length of this.
Employer pays for permit parking for staff - they don't own our cars - the site is an open air car park managed by Vinci.
My employer never signed a contract of was given t & c's so we were unaware of any.
In June of last year, I received a pcn - as there is a big sign at the entrance saying that the area is managed and parking is subject to contract, I thought I had to get my employer to deal with it. They told me to ignore the ticket as the space was paid for and would deal if any chase was received. I heard nothing on that one so assumed was told the right thing.
However, received another two pcns, one in November and another in October 2014 - failure to display pass in right place and partially obscured on another. told to ignore as above.
Received a RKN issued on 5th December passed to employer who wrote a letter to Vinci on 16th December providing evidence that bay was paid for, not quoting and PCN numbers just my registration. A response was received on 4th January 2015 which mentioned a POPLA appeal and unknown to me as I was not in for the first week after Christmas break, they launched an insubstantial appeal to POPLA without my knowledge - Vinci never informed them that the appeal had to come from the driver or registered keeper.
Vinci only supplied one pcn reference to my employer and never mentioned that each ticket had to be appealed separately. I have since found out that the remaining tickets were passed to debt recovery on 5th January.
My employer had already told Vinci that I was the registered keeper and driver at that point so I rang ZZPS and they could not find the pcn number given for the appeal but mentioned 3 others, of which I am only aware of 2 - they again never mentioned appealing separately on each ticket. Thought maybe they were linked.
I sent off several letters to POPLA asking them to include additional points in the appeal from my employer - I never received an acknowledgement and neither did my employer.
POPLA rejected the initial appeal from my employer on 4th of March - the response was very short and did not respond to any of the points raised in my letters.
ZZPS said the matter was referred to WH on 9th March - to date I have not received any communication from WH.
POPLA rejected the appeal in early March and they refuse to speak with me as I am not the appellant.
After going out of my way to look for the T & C's once Vinci made us aware of them in the original appeal rejection. There is one small sign at the entrance, which you could not read unless you were stood in front of it and confirms and initial charge of £50 applies if the permit is not displayed properly. There is not one sign inside the parking area confirming the t & c's - until this point I did not know about them. spoke BPA and gentleman told me on phone that this was a breach of their guidelines and no contract exits but since then I have emailed asking for written confirmation to this effect and cant get a straight answer.
Questions
Can POPLA accept an appeal from a third party without evidence that the driver/reg keeper agrees to them doing so?
In doing so, I have been denied the chance to appeal in a thorough way. They say the tickets were outside of the appeal timescales but so was the one that they gave a code for as I understand it.
Can anyone comment on the signage question and tell me if the entrance sign alone is enough?
Can anyone comment on whether or not the inclusion of a £50 penalty on a permit can be classed as punitive in nature, as the landlord has not suffered any loss as a consequence of my alleged breach of contract. The way I have read other posts suggests that it is but maybe I am only seeing what I want to see0 -
Dear Vinci,
The bay against which you issued PCNs on the vehicle parked therein was paid for - there was no loss to your company or the landowner. Also, your signage can in no way whatsoever be deemed to implement contractual terms.
Please cancel these PCNs forthwith, and add my vehicle registration to your whitelist to avoid any further PCNs. If you disagree then I'll see you in court.
PS - where are the VAT invoices if you're claiming a contractual charge?
