    Myself and Jpears have always argued this was the case. Glad it has now been clarified.

    In my and Justice's view, this was already clarified in the UK by the Gahan case. Others including Emirates thought otherwise.

    the bit that is still missing (as far as I can see) is when different airlines are involved.
    If I buy a ticket from BA for LHR-SIN-PER (with the SIN-PER being operated by Qantas) and the LHR-SIN is all on time but the SIN-PER flight is delayed 6 hours due to technical problem...who would the claim be from?
    Qantas as the operating airline of the delayed flight (which was non-EU to non-EU on a non-EU airline) or BA who operated their flight on time?

    This is a point I have already raised up when we last had this discussion. I said that the airline might stop doing all one ticket flights especially when the 2nd leg starts outside of the EU.

    I am submitting a complaint due to missed connection in Dubai, meaning over 4 hours late arriving at destination.


    Our flight departed from Dublin - does this make any difference?

    There are a few questions. Was it on a single ticket. From where to where including stopovers. What caused the delay in Dubai.

    Yes it was a single ticket to Melbourne with a stop in Dubai


    There was only a 1hr 20min allowed for the Dubai connection.


    Flight from Dublin was delayed supposedly for 1 hr due to air traffic restrictions and for 20 mins due to airport congestion.


    Flight made up time, and arrived in Dubai just 20 mins late, and we were able to get to the gate for our original connecting flight (To see if we could convince them to let us board) - but our boarding passes had already been cancelled in Dublin. and we were booked onto the next flight.


    The missed connection is due to the short connection time and the delayed flight from Dublin (and In my opinion the ineffiecieny of emirates for removing us from our original flight before they knew our time of arrival in Dubai)
