    I had a small claims case open, via MCOL. They were keen to wrap this up after the supreme court Permission to appeal was denied.

    for them it was a damage limitation and cost saving exercise.. DLA Piper was literally begging me to lodge a notice of discontinuation n279 to the court. I said only when the money is in the bank and you pay my legal costs.

    I'm about to launch a similar claim against Emirates, but conscious I'm near the five year limit. How long prior would I have to raise a MCOL to ensure it met the deadline?

    You have 6 years, not five, to commence legal action so no rush:)

    In response to your question, your legal paperwork has to have been received/processed by the court before the 5 years is up.

    I would have been out of time by the time I lodged anything but Emirates paid up anyway with only a little prompting. This was a catering vehicle hitting the plane causing damage.
