Only if it was brought online. It may have been purchased in store but been delivered if the op couldn't get it home themselves.
True, didn't spot that possibility. Distant Selling Regulations only apply when the customer does not have the opportunity to inspect the item before purchasing. If the TV was purchased in-store but delivered later, this regulation would not apply.0 -
I'm surprised at the amount of replies that were of the 'tough' type.
I've noticed over the last while that there's quite a lot of people who take that kind of view about this kind of situation and seem to come down on the side of the company rather than the consumer.
I'm not saying you are all wrong btw, I'm just a bit surprised that's all. Given the kind of site this is and the fact that Martin advocates striving for the beat deal you can get etc etc, I would have thought more people would have been suggesting more positive actions rather than just immediately 'give up' iyswim.
I agree it would be morally wrong to try to get a refund through lying or other dubious means but I think it is only good sense to at least try to get the difference refunded. If it doesn't work, accept it and move on as you aren't really entitled to it anyway. But it would be foolish to not even give it a try.
A few quid to me is a fiver or a tenner and might not be worth my time or the hassle that may be involved but fifty odd quid pays one of my monthly direct debit bills and a refund of this amount would be worth trying to get imo.
Anyway, my old school pal is married to the manager of a store (not JL) and he says that many stores will refund the difference purely as a goodwill gesture as it is worth it to them to keep a customer happy and it is definately worth approaching the store and pointing out how unfair the situation is and asking politely if they would consider refunding the difference to you. He says this is only worth trying if the price has only just come down, you usually wont be treated sympathetically if any length of time has passed.
None of this is of any use to the OP now as I see he/she is getting the tv refunded anyway.

excuse me i am op are you comparing me to a shoplifter for asking if there was anything i could do about price drop as in do john lewis have a policy like amazon?
and the fact that it had 2 scratches i was well within my rights to ask for refund it was over £735 would you accept it?? i think not
anyway i got call from john lewis today after emailing photos of damage and explained that if they refunded the difference i could live with the scratches even tho i could have taken a refund and then purchase it again at lower price to which they aggreed so everyones happy i have reduced price john lewis dont have to uplift a damaged tv.

If the business can afford to sell the TV at £679 and make a profit, then it was clearly overpriced at £735.0
