Bailiff for parking ticket

I'm desperate for some help please . I overstayed the free time at the Range in St. helens some time back . It was at night and I was the only car parked up as I was out for a meal with my wife . I received a parking ticket issued by parking eye and the advise at the time was to bin it so I did . I got a couple more reminders and threats but binned them and all .

Today I got a txt from NEWLYN stating they are going to be coming round to recover goods in order to pay for a parking ticket . This has scared the life out of me as I have so little as it is and such an event would be frightening for my kids to see etc .

The problem I have is that I don't have any correspondence at all , no reference numbers etc . All I know is that Parking eye issued the ticket .

I don't know where to start to resolve this situation. Who to contact first etc . Is it possible to get this parking ticket number or is it well beyond that point ? I really don't know where to turn and any advise would be much appreciated . Am I literally up the creek now without a paddle or is there anything I can do to start ?

    sounds to be a counsil ticket


    how do you know the thing is due to PE , did they take you to court ?


    lots of info missing from your post


    you need to contact NEWLYN by phone and ask who they are collecting the money/goods for , the name and date of the court and the date the warrant was issued.

    Sorry for the lack of info but I am not anywhere near clued up on any of the procedures etc so apologise if i have failed to put everything in . I was threated in a letter from Parking eye that they would take me to court if i didnt pay but i never received a summons or court date or anything of the sort . In the letter they said that should they win that I would be liable for costs and they would be looking to recover these costs .
    I dont know what is meant by ' due to PE' unfortunately . It was definately a parking eye ticket hence why I ignored it .

    do you think perhaps this txt was random spam type and ive got all worked up for nothing ? I don't know how they got hold of my number as i've never rang parking eye or any organisation like that ?

    And who gave you this advise (sic)? It has not been advise (sic) for 2.5 years! Are they now helping you to resolve this following their wholly inaccurate advice? They need to take on some responsibility for where you now find yourself!

    Are you sure the Parking Company is definitely ParkingEye? I don't associate them with Newlyn. Double check any paperwork you have. We need to know precisely who you/we are dealing with.

    Can you give us a timeline of:

    1. Date of parking event.
    2. Windscreen ticket or postal Notice to Keeper (if so when received).
    3. Any subsequent communication, and who from?

    reply back saying it is defiantly PE , then others will help , PE often go for CCJs , but don,t usually go down the collecting road , post further down , PE got a ccj but arnt chasing https://forums.moneysavingexpert.com/discussion/5199132

    thanks for clearing up the PE bit . It was definately a ticket from PE and it came through in the post .Having never before heard of PE I googled them and the advise on the Watchdog video was to simply bin the correspondence . If im not mistaken , it was Martin lewis being interviewed by Anne Robinson where he folds the ticket up into a paper plane and flies it into the bin to demonstrate that there was not legal obligation to pay the ticket . It could well be issued nearly 2 years ago but I cannot be sure . I will try to find if perhaps my wife kept any of the letters and then i can provide a more accurate account with regards to the date of the offence .

    I have come across a thread on the forum which does link NEWLYN to parking tickets (but I can't posts links on here)
    I have tried to ring the number from which the txt came but there is no answer , perhaps as its late now .

    Is there anyway I can contact anyone who could give me a reference number for the ticket ? perhaps Parking eye direct ? then I could have an accurate date , should i not be able to recover any paperwork from my side .

    newlyn , "generally" do work for the counsils , the links tyou have found , check them , if they are PE check the dates and reply back if you spot one in the last , say 3 yrs


    post the links , but just change the http to hxxp


    NO do not contact parking eye , your contact is with NEWLYN first thing in the morning , asking the information mentioned above




    still think its a counsil parking ticket

    1. Am I right in thinking that that a bailiff can only collect on a court order/CCJ? The OP says he never got a CC summons.
    2. How did Newlyn get your phone number?
    3. Would a bailiff actually text you or would they phone you?

    My guess is that Newlynn won't even know what you're on about.

    Newlyn Bailiffs also act as debt collectors, however they don't differentiate in what capacity they are working when they send letters.

    If they are acting as bailiffs you will have a CCJ or an order of recovery from the TEC, both of which should have been officially notified.

    1. Unfortunately that doesn't mean that by whatever method a default CCJ hasn't been obtained and the PPC, PE - if it is them, aren't now looking to legally enforce the judgment.

    However, if it is a Newlyn bailiff i.e. a certificated bailiff as opposed to a county court bailiff (stay with me Freddy - there are two types of bailiff in this context and they aren't to be confused) then they have no powers with which to enforce a debt from the small claims court. Such debts can only be enforced by a (suitably empowered) county court bailiff.

    If, on the other hand, the so-called bailiff is actually a High Court Enforcement Officer (as in "The Sheriffs are Coming") then they could enforce a debt if the debt was of sufficient value and was legally transferred to the High Court. Then again I've never known HCEO's to !!!!!foot around with texts. They rapidly get in your face with a view to collecting without delay.

    2. Telephone directories/trace agents/credit reference agencies etc etc. There are a multiplicity of legitimate sources. If ever you have an ex-directory number the only way to keep it that way is to absolutely never give it to anyone - well, certainly not a commercial entity of any type.

    3. Why wouldn't a bailiff call you? His time is as precious as everyone else's and saving a wasted journey to knock the door is just plain sensible as well as cost-effective. However, when was the last time you heard of a bailiff foregoing the opportunity to rack up costs by making a call to an address?

    With all that having been said Newlyn have form for deliberately trailing their bailiff coat tails in an effort to frighten people into responding to them. I suspect that that is what applies here and the truth is that Newlyn are simply acting as debt collectors rather than as bailiffs.

    This all assumes that their interest isn't actually in respect of a LA issued ticket as opposed to a PE PCN from the Range.

    As for the interrupting troll perhaps he could go and find a quiet, damp corner on his own or preferably with his PPC pals.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
