    yes, email him with the timeline, all correspondence etc

    ask him to investigate the lack of a popla code or cancellation as you appealed well within the 28 days allowed
  • Am presuming I write back to Care saying did appeal in time, they ignored and have now sent complaint to s clarke?
    And basically to go fish!

  • Emailed the BPA, they are denying receiving my first appeal. but have acknowledge my second appeal when the NTK arrived. However, they are saying that as it was after 28 days from the initial PCN I still have to pay and have no right to appeal, is this correct?

    nobody HAS to pay !

    the BPA may advise you to pay, but advise is just that , advice, nobody but a judge and court order can FORCE you to pay

    so who is saying you appealed out of time ? (the 28 days)

    is it the BPA ? (aoscompliance or s clark ?)

    or the PPC ?

    assuming the BPA are saying its outside of the 28 day appeal period (you were not clear about this, because "they are saying" doesnt make it clear WHO is saying ), then no you cannot get a popla code from the PPC and that would mean the BPA would have washed their hands of it due to you having no proof of posting (which is free from the post office, so remember next time)
  • Thanks for replying, I'll recap as I'm getting confused myself!!

    PCN received (I left my car overnight in a free carpark, didn't see signs that couldn't leave overnight but assumed that as it was a free carpark there were no time limits)
    Appealed within 3 days but Care are saying they didn't receive this initial appeal
    Got NTK and appealed this
    Next correspondence was from DRP demanding payment of £160 within 7 days
    Sent letter to Care with copy of appeal
    Emailed BPA s clarke who forwarded to colleague
    BPA contacted Care
    Care have acknowledge my second appeal and have said because I didn't appeal within 28 days my appeal has been denied
    Emailed BPA asking do I not have 28 days after NTK - awaiting response
    Received 2nd letter from DRP - notice of intended court action. Within this letter it says that "A Court Judgement against you could seriously affect your ability to obtain credit in the future". I'm sure I read somewhere that this is not the case, can you please confirm.

  • Have just received email from BPA - Care are saying that they requested proof of postage during a telephone conversation. I have never had any dealings with Care or Anchor over the phone, purely through postal correspondence.
    I find it incredulous that they (Care) can claim that they have only received one of my 3 correspondences with them then blatantly lie that they have had a phone conversation with me!

    You are in the right as long as you appealed as KEEPER, not talking about who was driving. Hope you have not said anything about who was driving in that NTK appeal nor in the complaint? Trouble is, by telling them about ''getting the windscreen PCN and making a first appeal'', it's almost admitting to driving! You should not have mentioned the first PCN, should have merely said to the BPA 'I am the keeper and when I got a NTK I appealed but...'

    Never mind it's only Care Parking. Even if you can't get a POPLA code just ignore them.

    The advice about how to appeal to a parking firm needs updating quickly and making a stickie.
    They have changed tact again and now many ignore appeals you can not prove you posted.
    Or they pick and chose what they think counts as an appeal.

    Certificate of postage is the best advice, you can either prove you posted it or you can not.
    We appear to have forgotten we are not dealing with honest people.
    I do Contracts, all day every day.
  • I am appealing as the keeper and not the driver, have never acknowledge who the driver was.
    They certainly aren't honest, it will be interesting to see how they can confirm my non existent telephone conversation
