Hi
I received a PCN back in Oct, sent appeal as per the newbie thread on here.
I have not received a Debt Recovery Letter with no correspondence in between.
Can someone please advise the best way forward now. I have seen a response on another thread have copied it here, is this what I should send now.
Thanks in advance

On the date XXXX you were sent an appeal to parking charge notice XXXXX
Here is a copy of that appeal
You have chosen to completely ignore said appeal
Under POFA 2012 keeper liability relies upon having access to an appeal.
You have refused that access and therefore the keeper now serves notice that they are no longer liable under keeper Liability of POFA 2012.
Howver as POFA sets no time limit on hearing of appeal the offer to hear and judge the appeal must remain open until my death.
Your call.

who is the PPC ?
did you appeal within 28 days ?
by what method did you appeal ?
if by post, did you get a free certificate of posting ?0 -
Sorry I've just noticed that my initial letter said I await response in 35 days which I obv didn't receive! will this help0
-
depends on the date on the letter
until you help us by answering some details, you cannot expect a decent reply that will actually help you0 -
It was Care Parking. I appealed within 28 days via post but didn't get proof of posting!!0

ok , well as that is Anchor Security Services Ltd t/as Care Parking and they are BPA members you should send something like that letter to them, plus COMPLAIN to the BPA s clark (see NEWBIES sticky thread) that you never received an answer or a popla code witin the 35 days, give him copies of all paperwork and let the BPA AOS deal with it
include the DRP letter too , so all correspondence and a timeline of dates, yours included
IGNORE DRP0 -
Thanks very much for that. I must admit I was really surprised to get Debt Recovery Letter, especially given the time that had passed! I've been in a panic all weekend thinking I should just pay before it goes either up or to court!!
Sorry to sound a bit thick but do I just use the wording above or do I need to include anything else?0 -
depends who you are writing to
you could use or adapt the wording above to go to CARE
you need to write an email asap to s clark with your complaint and attach all docs etc like I said, ASAP if not before
they have up to 6 years to bring a small claim, so get cracking on this now
DRP are powerless, so ignore them0 -
Thanks, I am a bit confused (doesn't take much) as to what I should say to s clark at BPA. Am I complaining to him about unfair and unjust charges from Care? Have read the post you said and clicked on the links but can't find the right wording, I don't want to get it wrong as certainly not in a position to pay the charges especially as they have gone up to £180!!0

You need to complain to S Clark, only that you appealed in time and have received no reply from PPC only a letter from DR Plus, send him a copy of your appeal and dates.0
-
Have sent a reply to Care as per above and they have replied saying that I didn't appeal in time but I did!
I initially appealed just 5 days after the PCN was issued. Am presuming they are clutching at straws. Will send email of complaint to S Clark as they appeared to completely ignore my appeal!
Shall I just reply including all correspondance (they have actually returned my initial letter which has the date on it 5 days after the initial PCN!!)0
