Blue Badge rejection

I have been virtually unable to walk - for the last year, due to a very painful Hyperextended knee !!
(I struggle to walk to the bottom of the garden - 20 metres)
I applied for a blue badge but was rejected on the grounds that my disability is not bad enough !!!
(This was without any medical)
I have no right of appeal
What annoys me is that I regularly see people, parking their blue badged cars on double yellow lines and walking away to the shops etc without any problems at all....
What are the criteria for a successful claim ??

Do you fit into the automatic criteria?
Although there is no formal right to appeal you can write and ask for a review. Have you evidence to back up your claim from medical professionals?0 -

Quite possibly they are using someone else's badge?
They may well be using the badge that belongs to their wife/husband/daughter/son/cousin and shopping on their behalf?
I too see this happening, especially in the evening outside the various pubs and clubs. A car full of teenagers emerge to go to a club leaving the badge on the dashboard.
The system is wide open to abuse and very few are caught out.
A friend's daughter uses her mum's badge when she goes shopping in Cardiff city centre with her friends.0 -

Even using someone's badge is illegal and can lead to removal of the badge and a prosecution.Someone please tell me what money is0 -

Of course I do - yes
Why is it a joke ?0 -
In which case if you get mobility components you should get blue badge. Apply again sending in evidence of dla/pip0

DLA [HRM] is without further assessment and 8 points or more under the ‘Moving Around’ activity of the mobility component of PIP [because they cannot stand and walk (aided or unaided) more than 50 metres] is without further assessment and a legislative link to automatic Blue Badge eligibility is provided for. Anyone outside this criterion can and should if the feel they deserve it apply for a blue badge 'subject to further assessment'.
NOTE : An average adult step is just less than one metre, which is 1.1 yards or 3 feet and 4 inches. If you walk alongside someone and they take 100 steps you would have walked roughly 90 metres, or 100 yards. they then take into account total time, time with rest and time of rest, shortness of breath, uphill or level, breathlessness, and many dozens of other things.
If at the end of this qualified occupational therapist delivered 'subject to further assessment' 'independent mobility assessment' you are deemed to be worthy you get a blue badge. If anyone feels they were refused unfairly they should appeal in writing stating why they feel they are entitled to a Blue Badge, giving specific information on the conditions that impact your mobility. All costs if you are again refused by a different qualified occupational therapist in my view should be borne by the applicant.
Best of luck.Disclaimer : Everything I write on this forum is my opinion. I try to be an even-handed poster and accept that you at times may not agree with these opinions or how I choose to express them, this is not my problem. If that is the case, why then I have I heard over the weekend of someone that has had HRM of DLA since the mid 90's, regularly has a Motability car, gets an automatic BB, yet has failed to get anywhere near the 8 points of PIP despite a MR?
It's a complete joke to be honest. Even the genuine cases are being refused.
His car was repossessed 3 weeks after he failed the assessment, he has handed back his BB and is now more or less housebound due to not having any public transport links where he lives.
Additionally he didn't make the grade for the caring side either even though he was awarded MRC for the same length of time.0 -
PIP has different descriptors than DLA, so it is possible for someone on DLA to find that they are not eligible for PIP. In addition, it is also possible that people improve and fail to inform the DLA unit, so when they apply for PIP, they do not pass the medical.
I'm not saying that this is the case with your friend, benniebert, just pointing out what is possible.0
