If anyone sees BBs being misused, take the registration number and report them.
    Simples.

But how do you know it's actually being misused?

Just because the narrow mindedness is that "oh they can walk alright they don't need a BB" what about those with heart defects and endless other disabilites that cannot be seen.

    Guilty until proven disabled?

    I was applying under :
"you have a permanent and substantial disability which causes inability to walk or very considerable difficulty in walking."
    Which is extremely vague !
incidentally - my award of DLA was for an indefinite period

What award of DLA? You can only apply for an automatic BB if you receive HRM.

That definition is better than the previous one which was even vaguer: ......'virtually unable to walk'.

My rejection stated that I could not reapply for a further 6 months !

That is unless you develop a very serious deterioration in the meantime I presume?

But not being able to re-apply within 6 months for the same condition and for the same inability level would be sensible, otherwise we would have the ESA roundabout system all over again - fail - apply - fail - apply....

And I suppose you would be attaching exterior CCTV cameras around your house as suggested by that senior police officer in the newspaper to watch for inconsiderate motorists and/or drunk and incapable individuals that take a pee in a neighbour's garden after the pubs are shut, or even the ones that throw their used fish and chip wrappings into somebody's front garden?

You would have no proof if the BB is/was being misused. All you would be guilty of is dragging 'Old Bill' out to chase down a disabled motorist.

Mid care and lower mobility - I am aware of the automatic qualification rules - which is why I was applying under the assessed rules - but was not even offered an assessment !!

The regulations make it clear that there is no legal right for the LA to accept or review the decision under an appeal. It is however suggested that it is good practice to do so, that's all.

There is no reason why another application cannot be submitted.

All local authorities have complaints procedures so if they do not have an appeal process people should use that and make a Subject Access Request under the Data Protection Act to get the reasons. There are ways of dealing with arbitrary action.

However, in my experience people who make unsuccessful applications sometimes respond to questions by reference to a medical condition assuming this is reason enough. But the form requires them to explain the problems they have walking.
Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.
