Parking Eye PCN from Morrisons

Morning all,
First of all, I have spent considerable time reading the newbies thread, along with various others within this forum - and others as well. Before we go ahead and do anything though, i thought it may be best to drop a specific thread up, just in case we're misinterpreting anything.
So, yesterday we received a PCN from Parking Eye for £85 (£50 if paid within 14 days) as a result of overstaying the maximum free stay in Morrisons of 2 hours, by 33 minutes. The PCN was received by post within the 14 day period, and from what I can see it does adhere to POFA2012.
Now, we are frequent customers of the Morrisons in question, but on this occasion had used the car park to visit the local shops. As a result therefore, we don't have a receipt from that particular day to present with an appeal, and as such, I just wanted to confirm; Should we still go ahead and appeal this? And if so, is the standard appeal letter (as found in the newbies thread) the best way to go?
The two main concerns here are;
1) Whether the charge will potentially increase in the event of the appeal failing.
2) Advserse affect on credit rating - a mortgage application is currently being processed. I've read up on this too and i'm aware that it *can* have an impact, but only if you get as far as a CCJ being issued. Still though, the very possibility is a concern.
As ever, any help or guidance on this would be greatly appreciated.

Well for me when I got one from parking in Morrison, I wrote a letter to CEO of Morrison, and said that I am a regular shopper at Morrison and in this occasion after shopping I sat in the caf! to have something to eat, and they should contact parking eye to cancel the ticket, if not I would not be shopping there any more, because the time allowed for shopping and eating in their caf! was not enough. I did not shop in Morrison that day but I did not matter because I am a regular shopper anyway, and they did not ask to produce any receipts. Then they wrote to parking eye and cancelled the charge. I ignored the letter from parking eye until I got a letter before court action then I responded. But because the charge was cancelled by Morrison, that was the end of it0

Everything you read in the newbies thread is relevant to all PCNs, regardless of circumstances.
Yes appeal to Parking Eye using the standard template, this will fail. You will then get a code to appeal to POPLA which 'should' be successful if you follow the advice on here.
The charge will undoubtedly increase as you get further through the process, this is purely to scare people into paying up rather than fight. Again, follow the advice on here and you will likely win at the POPLA appeal stage.
Your credit rating will NOT be affected by this. The only time this comes into play is IF it goes to court AND you lose AND you don't pay in time after losing.
Also complain about this 'harassment' to the manager of Morrisons requesting that they arrange for the PCN to be cancelled - this avenue has often worked for others.0 -
If you appeal to Parking Eye with the template on the newbies thread, they will more likely than not cancel the charge.
It appears that they are doing this when it is clear that you are appealing on standard (i.e. forum assisted!) legal points that will win at POPLA, so they are saving themselves £27+VAT by cancelling the charge.Bournemouth - home of the Mighty Cherries0 -
better to appeal to PE and get it cancelled than risk ignoring and possible court and possible CCJ etc
if they dont cancel, you get it cancelled at popla later
on a side note you complain to David Potts at Morrissons too
like this one in the papers
http://www.telegraph.co.uk/finance/newsbysector/retailandconsumer/11438428/Dear-David-Potts-heres-how-to-get-Morrisons-back-on-track.html
never mind like this thread here (again by complaining to the CEO)
https://forums.moneysavingexpert.com/discussion/5188791
its all covered in the sticky threads
ie:- appeal to PE with the template letter
complain to CEO (emails or addresses in those sticky threads)
complain in store if you use it a lot and have receipts or bank statements
appeal to popla if a code is issued
so please, take the blinkers off, man up , fight back , and win0 -
Thanks for the replies, folks, I appreciate it!
Okay, i've just sent the following email through to Dalton Phillips, with Stacey Elsworth and David Potts copied:-
Dear Mr. Dalton Phillips,
PakingEye Reference No. XXXXX/XXXXXX
Morrisons Branch: Melton Mowbray
Apologies for the direct email, first of all. However, I feel that; a) I have no other choice but to contact you directly on this matter, and b) that you should be made aware of the situation.
As a regular customer to Morrison’s in Melton Mowbray (as well as Stamford (among other outlets)), I was shocked to receive a Parking Charge Notice from your agent, Parking Eye, infoming me that I have been charged £85 for overstaying in the carpark, along with various threats to "pursue" me. First of all I was (and remain) confused as to how exactly they have come to this extortionate amount - which bears no resemblence to the cost incurred by Parking Eye as a result of my stay, and secondly, I certainly do not appreciate such threats from an agent acting on behalf of Morrison's, as a result of simply shopping in your store. To make matters worse, this 'charge' was actually delivered to my elderly father, of whom was forced to endure the stress and worry that such a threatening letter inevitably brings. As a result of this I am appealing straight to yourself to review this case.
I must admit to finding it incredible that a store of Morrison's size and excellent reputation can allow such treatment of its customers to continue. As a long standing, loyal and previously satisfied customer I am disappointed that this is allowed to happen and I would appreciate it if the store could show discretion and cancel this Parking Charge with immediate effect. You will understand that I am reluctant to do my shopping at Morrison’s again until the charge has been cancelled.
I would be grateful for your assistance in this matter.
I'll see if anything comes of that. In the mean-time i'll go ahead and submit an appeal direct with PE using the tamplate in the newbies thread.
Thanks again.0 -
Actually, just got undeliverable messages for both Dalton Phillips and David Potts. The emails I had were;
1) Dalton.phillips@wmmorrisons.co.uk
2) david.potts@morrisonsplc.co.uk
Anyone happen to know what the correct contacts might be, seeing as these appear to be incorrect?0 -

But according to a quick Google search, he remains the acting CEO until the 15th of this month. Or so I thought.0 -
mmmm, beware the Ides of March !! lol
you will have to hope that Stacey passes it on0 -

Yeah, bad timing it would seem! I won't hold my breath on that avenue then.
Also just submitted an appeal via the PE site, using the newbie template. Slightly awkward though in the fact that my dad is the registered keeper, so everything i'm submitting on this is in his name, not mine. The last thing i'd want with that in mind, is this getting anywhere close to a court.0
