Sold Car Privately - Buyer Unhappy - Wants to return - Help

This was 2009 and I no longer worked for the dealer. I was then working for a recycling company.
Apologies yes it was £1100, plus costs.
It was in 2006 that you stated you were a car dealer and in 2009 you posted about being taken to court "about 3 years ago" for selling a car so what does your employment status in 2009 have to do with your selling a car in 2006?
I suppose it was also a coincidence that the car you were taken to court for was a Smart Roadster and in 2006 you worked as a car dealer selling Smart cars.

To Fred's post, the car had a new dial mass flywheel and clutch about two years ago and has driven fine up until I sold it.
Reverse was stiffer than other gears but car has always been like that since I owned it (5 years). Never had a problem engaging it.
Was using it fine the day before selling it.
Haven't done no sort of cover up or anything, just sold the car on because I bought a newer car.0 -

I don't get what you are saying here? I bought my wife a Smart Roadster direct from Mercedes. We sold it when our first child was born and bought her a Renault Scenic diesel as we felt that the Roadster was not suitable for her, a pram and an infant. The car was in her name, not mine.
If you are trying to say something else BE A MAN and say it rather than an adenoid fuelled idiot sat in anonymity snorting as you chuckle..
My whole post was aimed at people like you who are ill informed.
I suggest that rather than dribbling on your keyboard you go outside with your kids (if you have any, I doubt it) and enjoy Sunday, or spend it hunched over your keyboard @@ssing yourself off over your piousness.
The whole reason for my posts was because you stated that you were taken to court for selling a car privately and that you had to pay costs for the court case, something that is highly unlikely if you were selling as a private individual.
You then stated you sold the car in 2009 (when no longer a trader), but your posts clearly show this to be incorrect as earlier posts state that it happened in 2006.
You even got the amount that you were fined incorrect. Once it was £1100 and other times it was £1800.
If you can't even get the timescale correct to within 3 years and the price varies by over 50%, exactly how much credibility do you think should be given to your claim of going to court, losing and having to pay costs? as going by your recent history, you've probably managed to make a mistake with that as well.0 -

Hi. I lost because the judge stated that the fault must have been there when I sold it.
I pointed out that I took great effort to stress that the car did not have the symptoms of this fault (wet carpet behind the drivers seat) when sold.
I still lost even though the buyer admitted that he had used a pressure washer to clean the car.

Hi guys
Quick update which has left me a bit confused.
The claimant has to pay the court fee by the 26th June with papers due to be submitted to the court and each other by Friday 10th July.
I spoke to the court on Wednesday and they confirmed the fee has not been paid. I sent off my documents on Wednesday recorded delivery.
I received a letter from the court today giving me a court date in August and also in a different court to where they told me it would be allocated.
I'm a bit confused because how can they allocate a date if the claimant is not sticking to the terms that was stated in the allocation order (payment date AND serve date).
What should I do next? - Can I ask the court to dismiss the case based on this? - Otherwise what is the point of deadlines. I've followed their instructions and also was proactive in reaching out to the claimant regarding an inspection (to which I received no reply).

The hearing would normally be at the court of your choice. So if the appointed court is not the one you requested then request a change.0

Possibly their departments are not communicating. I would email them so you have it in writins (or as close as). If they have not paid then I doubt it will go ahead, but please dont take my word for it.0
