The buyer would just say they tried to mitigate their losses when you failed to refund. So a judge would then use what other evidence is available - and if they don't consider the other report as independent then that just leaves their word versus yours0

This thread is rapidly putting me off selling privately again.
Hearing about problems such as the one on the thread is a bit like reading about problems on the ebay forum.
There are thousands of sales each day and the very large majority of them go through with no problems at all yet you never get to read about these.
It's the tiny minority of sales where something untoward happens that get written about.
Yes, you might be one of the unlucky sellers when it comes to getting rid of your motor but it's far more likely that you will be someone who sells a car, gets the money and lives happily ever after.0 -

Hmmm so its taken them the best part of three months to tell the OP they no longer have the car? Think they've realised now the games up as they cant arrange to get the car independently inspected as directed. Their generous offer of a reduction in repair cost tells it all really, their last ditch attempt to extract money from the OP hoping they'll panic and pay it.
It would be interesting to see if they could come up with paperwork for the repair, where and when it was done and what parts were involved. I would guess they had their friend bodge it to sell on.0 -

That is quite unbelievable. If they are alleging that the supposed fault cost them £200 off the sale price then they didn't get much of a repair for their £1,500 or £700 or whatever number they pluck out of the air next.
Plus, since the car is no longer available for inspection, who can say why it sold for £200 less than they bought it for? Maybe there's a bloody great dent on it that wan't there when you sold it. Or perhaps they are just as crap at negotiating as they are at litigating.Je suis Charlie.0 -

I'd love to know how they advertised it, how much they sold it for, and how they answered the buyer's questions - 'had any problems with it?'...0
