AFAIK, an appeal to have a judgment set aside is when you are out of time to appeal the original Judgement, you have a limited time to appeal the Judges decision by pushing it to a circuit Judge, but this is the point that I feel uncomfortable because I am not a lawyer and I have not had any legal training, personally I would appeal and shout from the roof tops!! But that's just me, I would either consult a NWNF solicitor or make your own mind up on what you want to do, I don't think even The Jedi Master himself would tell you what to do, he only ever issues guidance to his followers ::A

Follow the instructions on the order. Which means writing to the court with a copy of the Allen judgement. I reckon that will fix it.

does anyone know when time barred case is in march. been fighting jet2 for over a year .now had letter saying my file closed because of 2yr time barred.flt was 2009 so running out time

Hi denised. The time limit is 6 years not 2 ("The Dawson Case"). Do not waste your valuable time going back to Jet2 as they will brush you off again. Equip yourself with a large cup of coffee, then read "Vauban's Guide", downloadable from the forum, and the messages in the Jet2 thread.

At this point take a deep breath and decide if you have the time, patience and few quid for a dustup. If you do, go to Money Claim online or a 'no win no fee' lawyer and launch proceedings.

Interesting article in the Sunday Times today. After the ‘Allen Case’ the ST says that Ryanair are to appeal (don’t they need ‘leave’?) whilst Flybe and Thomas Cook have given up. Jet2 and Wizzair, whoever they are, have yet to decide their course of action. My Court has said it will find in my favour unless Jet2 produce, by the 20th, a good reason for not doing. I am not holding my breath!

I think Jet2 are getting boxed in, the Courts are in most cases lifting says post Allen and if Jet2 appeal, they will be asking the Courts to further stay cases until the expected Allen appeal is heard, personally I still think they will appeal, but the impression I get is that the Courts in general are getting a little fed up with the airlines antics.

Jet2 would be digging a very deep hole for themselves if they appeal IMHO.
