Really? Can you quote the law in question?
Frankly, No.
Why? Because I can't be arrsed to go and look through all my case law notes just because someone on a forum can't be arrsed to do a google search for the same info or turn a key off before using their phone.
eta: But don't worry, I'm sure that when you're trying to win that landmark case against Da Man the prosecutor will have all the references you could want right there for you

Your comment was 'if your engine is running you're "driving" for the purpose of using a mobile ...'
AFAIK while there is case law defining "driving"in various contexts, there is none related to mobile use.0 -

As it stands the law is quite clear that if your engine is running you're "driving" for the purpose of using a mobile and several other car-related activities.
If you feel it should be different from that then you're perfectly at liberty to get yourself ticketed, refuse the FP, go to court and try to set a new precedent.
But you'll probably find it's easier, cheaper and less stressful in the long run to just play the game as it stands and turn your engine off if you're going to use the phone - it only takes the turn of a key!

Nobody seems to have heard the term "In charge of a vehicle" which the OP clearly was.

Driving and supervising a learner are the two offences for phones.
Are you now claiming if you stop and jump into the passenger seat to make a call you are also guilty.0 -
