So has anyone had their credit rating affected through contesting these penalties? That's what they were suggesting in the programme, and perhaps one of the most important factors to consider if true.

People have when default judgements have been made against them. It's not just people who ignore court papers it's also people who have been unfortunate enough to move house at the "wrong" time.

Only if a person has lost at court, *then* hasn't paid the fine issued by the court within a month, or if they have, they've not applied to get the entry removed from the register.

It's certainly not on the say-so of a parking company if a person's credit rating is adversely affected.

Although PE have of late embarked on quite a few 'default' wins on claims on people that they suspected had moved. They traced them using tracing agents but only AFTER they'd got the judgements instead of BEFORE, which is the recommended way.

Some cynical people might accuse them of doing this deliberately but not I sir, not I.

For clarity ... in such cases the court issues a judgement, not a fine.

(The net result is the same though).
  • And to clarify further it's judgment ;)

As an alternative spelling, yes. :)

    OED agrees with me. ;)

  • "Life can often appear unfair, but motorists can go to POPLA should they wish to challenge an unfair parking ticket issued by a BPA Approved Operator"

So based on the fact that the majority if not all of forum helped POPLA appeals are allowed, if everybody went through POPLA with the usual points they would also be allowed. Does this mean all tickets are unfair? Mmmmmm

"Taken at face value, it does seem unfair to be penalised for overstaying time in a car park but there does need to be a cut off time and which must be adhered otherwise what’s the point in having one at all?"

Penalised?? Really? So according to the BPA they are penalties. Thanks for clearing that up

    No it doesn't:

However, the spelling judgment is conventional in legal contexts

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
