Hello
I owe much thanks to yourself ampersand and others on this thread as I got confirmation today that the parking appeal was accepted.
Unfortunately the appeal was granted due to the company not responding, I would have liked to win by legal brute force. But hey ho, a win is a win.
The reason for my appeal being accepted was:
"Reasons for the Assessor’s Determination
It is the Appellant’s case that the parking charge notice was issued incorrectly.
The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
Accordingly I have no option but to allow the appeal."
Thanks again guys, you do some great work to fight against these evil companies. I am now so much more educated and have already started sharing the knowledge with others.0 -
'I would have liked to win by legal brute force' - I understand that, bm.
But good news before the w/e:-) - just post it on POPLA successes too please, with Assessor's name. Helps us see who does what/ and why.
I'm delighted for you))) and sharing the knowledge is both good karma and payback against the lowlife.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

Hello,
More than happy to post my experience and help....
Are you referring to the POPLA Decisions sticky thread?
Just so it is posted in the correct place

Thanks, I will do that now.
In terms of the service I got from the company, i.e. them ignoring my appeals (that I had proof of sending) and forwarding my details incorrectly to a debt collection agency which scared my mother, which annoyed me greatly considering they had no right to do this. Can we report them to the BPA or another organisation?
Would there be any point do you think?
I just feel due to the experience I had, it shows one of two things.
1) The company intentionally ignores appeals so they can sell the debt to a collection company and they can still make a quick buck.
2) There internal processes / systems are so poor that even with dated and timed emails they missed two of my appeals.
Both of which is really unacceptable for a company to operate in this way.0 -
1) They don't sell the debt. The debt company has no financial interest in the claim, other than what the PPC pay for their services. The PPC simply uses their headed paper for a small fee to try and scare people into paying.0

Okay, thanks for clearing that up, I was under the following impression.
Imagine I owe a company £100. Company cannot recover it, so they sell it to a debt collection agency for £50. The company profits, because they get £50 for sending a letter or two. The debt collection company sees it as an investment because providing they can recover the debt, they can double their investment.
Not sure why I thought this haa....
Do debt collection agencies in other industries work like this? I cant have just dreamt this.0 -
Some industries do work like that. But it's very rare in the PPC industry.
CEL do (claim) to sell off 15% of a debt to a debt collector (DEAL), but DEAL are actually the same company as CEL so it's just another variation on the same scam.0 -

Thanks for filling me in on that
Any input to if I should complain, and who I should complain to?
