ParkingEye lose in court

I am coc-a-hoop. I have just won my case against ParkingEye.

This after they told me via mediation that they had won every case since Beavis so that I should give in.

Will get nearly £124 off them for earnings and travel costs.

More details later as I am on a train.

    Eagerly awaiting the details as I love it when PE lose in court, at POPLA or simply DNS at that latter stage. :j

    Not sure what DNS is, but it was in the County Court. Judge also refused them leave to appeal.

    The judge had not come across a ParkingEye case before and it therefore took nearly 2 hours instead of the 45 mins allocated.

    I won because of signage. The judge said it was totally plausible that the density of the signs meant that it was quite reasonable for me to not to have seen one.

    The fact that the nearest sign was behind tree branches didn't help them.

    I also made a great play on the fact that there was no sign at the entrance as there is at other car parks and that the sign I drove passed near the entrance would not have been visible unless I looked out of my side window.

    Their solicitor said that the signs were obvious if I had walked to the store from where I parked. But the judge looking at their diagram agreed it was possible to not see them.

    I also said I had gone back to the scene before the Court Case to establish that the sign wasn't obvious.

  • I should also add that the judge did say that the decision on the signage should have been the end of it but he also gave his views on the rest of the case.

    Standing to bring the case - Judge said that by a very narrow margin he agreed with PE. Although he did criticise them heavily for the redaction. He also said that their use of the commercially sensitive argument was not a valid one.

    Judge Molonley - Beavis case. PE relied heavily on this and again he said that PE had just about done enough to persuade him.

    I have to say, perhaps if I had come up with better arguments or a better delivery of argument, I reckon I could have won those too.

    Swindon - Halfords and the Range.

    I genuinely didn't see their signs so I could argue it quite convincingly.

    I pointed out that all other car parks in the area that I enter into have a sign at the entrance.

    The judge did say that I appeared to be a reasonable person and hence when I said that I did not see the signs he believed me and he also checked out their layout plan and the route I would have taken. So the advice here is wear a suit and sound reasonable!

    any chance of naming and shaming the car park?
    If this was a supermarket chain then I would be seeking full on publicity against that supermarket, highlighting the stress anxiety worry etc etc that this supermarket ( or retail park/car park owner) has caused you as a result of their agents actions - and I would also be demanding that the car park owner take action to remove parking eye, or disable their systems ( black bag over cameras?)

    The mediation was me offering them £10 and them wanting £150.

    This has cost them big time. Court fees, solicitors costs plus they will have to pay me £124 for £90 loss of earnings and £34 travel.

    Let this be a lesson to you ParkingEye.

    Halfords and the Range. I will never shop there again. Slimeballs. I did overstay but then I bought lots of stuff (in Halfords) too and it was because I bumped into a friend and we had a coffee that I was over the 2 hours. Had I known, I would never have overstayed.
